6NYCRR Sections 6.2 and 6.3 Notice of Adoption

Pursuant to the Environmental Conservation Law, Sections 11-1101 and 11-1103, the Department of Environmental Conservation hereby gives notice of the following:

Notice of Adoption for 6NYCRR Sections 6.2 and 6.3 relating to trapping regulations for beaver trapping in areas closed to river otter trapping within the Southern Zone. This notice will be published in issue 5 of the State Register, dated 2/2/2005 and is effective upon publication.

Final Amendment No. 1 to the FFY 2005 CWSRF Intended Use Plan
Supplemental Financing Program & Issuance Cost Revision

The Federal Fiscal Year (FFY) 2005 Intended Use Plan (IUP) for the Clean Water State Revolving Fund (CWSRF) for Water Pollution Control Projects, dated September 2004, has been amended.

Amendment No. 1 to the FFY 2005 IUP discusses the Supplemental Financing Program. This program will provide supplemental funds for the CWSRF which will allow long-term financing of projects in Categories A and B of the Annual Project Priority List that have a CWSRF short-term loan and need long-term financing by the end of the IUP financing period (September 30, 2005).

Amendment No. 1 revises the Finance Issuance Costs associated with processing a CWSRF long-term leveraged financing. The Direct Expenses portion of the Issuance Costs has been reduced from 1.2% to 1.0% of the amount being financed.

Amendment No. 1 also clarifies how the expiration dates for existing financial hardship letters have been determined for some applicants that have CWSRF short-term loans.

Copies of the draft amendment were mailed to those applicants with projects on Categories A and B of the IUP Annual List. A notice of availability of draft Amendment No. 1 was also mailed to other interested parties. The New York State Environmental Facilities Corporation (EFC) accepted comments on Amendment No. 1 through Friday, December 17, 2004, the close of the comment period for the Amendment. No public comments were received that affected projects to be funded in the current IUP financing period or necessitated revision of the amendment. Therefore, Amendment No. 1 is considered final.
