The applicant proposes a maximum discharge of 1,440 gallons per day of treated stormwater, via a storm drain,  to Lake Champlain, a Class A body of water.  The stormwater is collected from a bulk storage containment area and loading dock area, and is discharged through an oil/water separator at the existing facility located at 4654 Lake Shore Road, Plattburgh.  The above-ground bulk storage and transfer facility has been empty of product and inactive since June 2004.  The previous permittee, Griffith Oil Company, had their State Pollutant Discharge Elimination System (SPDES) permit deleted after they ceased operations at the site.  The current owner, Bray Terminals, Inc. has now applied for a new SPDES permit.

The Department has made a tentative determination to issue the new SPDES permit, which establishes new limits and sampling requirements that are more restrictive than the previous permit.  This tentative determination indicates that the discharge regulated under Article 17 of the Environmental Conservation Law is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time.  As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on pemrit issuance.  As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.
