The applicant proposes to install a pool and deck on the seaward side of an existing single family dwelling.  The deck is proposed within 2 feet of the tidal wetlands and the pool is proposed within 3 feet of the tidal wetlands at this site.  Variance from the 75 foot minimum setback for structures has been requested.  Variance from the 20% maximum lot coverage requirement has also been requested.  The project is located at 2704 Easa Place, Bellmore, Town of Hempstead, Nassau County, NCTM# Section 63, Block 315, Lot 49.  

The applicant requested this modification to add two existing units, 01 and 02, to the TBG Title IV Acid Rain permit.  These two units no longer qualify for exemption from the acid rain permit requirements since the TBG Cogen facility's energy service agreement with Northrop Grumman Corporation has expired.  The Department has prepared a Draft Permit and has made a tentative determination to approve this application for modification of the existing Title 4 permit.  Units 01 and 02 each consist of a combustion turbine and associated heat recovery steam generator (HRSG). Each HRSG is equipped with a duct burner for supplemental firing.  

In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title IV Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title IV files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.  It is recommended that an appointment be made to confirm the availability of the subject files.  The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.  A public hearing may be legislative or adjudicatory.  A legislative public hearing is a proceeding which provides an additional opportunity for public comment.  DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists.   If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments.   The applicant and all persons who  have filed comments on the permit will be notified by mail of the public hearing.  Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination.  An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.   A copy of the Department's permit hearing procedures is available upon request or on the Department web site at: http://www.dec.state.ny.us/website/ohms/gudph1.htm.

The applicant proposes to install a temporary dewatering system to allow for the construction of a test pit and subsequent inspection and sampling of the Bergen Point Wastewater Treatment Plant's outfall pipe in Gilgo State Park.  Two pumps with capacities of 1500 gallons per minute will be used to pump an estimated 1,431,360 gallons per day for a period of up to 3 weeks.  All pumped material will be discharged into a silt settling chamber and flow through a filter prior to being discharged back onto the surrounding ground.  The project is located in Gilgo State Park south of Cedar Island in the Town of Babylon in Suffolk County, SCTM# 100-241-01-001.1

The applicant proposes to construct a single family dwelling, garage, and driveway and install a septic system.  NYSDEC regulated freshwater wetland known as P2 is located on the parcel. Clearing is proposed within 14' of the freshwater wetland boundary, the single family dwelling is proposed within 25' of freshwater wetland boundary, and the septic system is proposed within 55' of the freshwater wetland boundary.  The project is located on the south side of Fairview Avenue and the west side of Fourth Avenue, Patchogue, Town of Brookhaven, Suffolk County.  SCTM # 200865458.

The applicant proposes to establish a marina for the dockage of approximately 50 vessels. The basin area is proposed to be maintenance dredged to a depth of 6 feet below apparent low water with resultant 2,500 cubic yards of dredge spoil to be placed on the upland portion of the property.  Install an 8 foot by 240 foot float having 8 finger piers, an 8 foot by 200 foot float having 6 finger piers, a 3 foot by 143 foot cantilevered walkway having 5 finger piers, a 25 foot by 50 foot travel lift, resheath 1,782 feet of existing bulkhead, and replace a 52 foot section of existing bulkhead.  The project is located at the corner of Atlantic Avenue and Clyde Street, West Sayville, Town of Islip, SCTM # 500-452-1-1,2.1,2.2,3.
