The company has submitted an application to the Department of Environmental Conservation to modify its current Air State Facility Permit for its asphalt plant located on Settles Hill Road, which produces bituminous concrete mixes for the construction industry. This modification would authorize the company to burn Waste Fuel A in the burner heating the stone for mixing with the asphalt. Waste Fuel A is classified as used engine lubricating oil and any other oil, including but not limited to, fuel oil, motor oil, gear oil, cutting oil, transmission fluid, hydraulic fluid, dielectric fluid, oil storage tank residue, animal oil, and vegetable oil, which has been contaminated by physical or chemical impurities, through use or accident, and has not subsequently been re-refined. The Department has reviewed
the application and prepared a draft permit for the facility
which requires that the company maintain records of the quantity of waste oils received
and their certifications which prove that the oils meet the definition of Waste Oil A.
The permit application,
draft permit and all other materials available to the Department
that are relevant to this permitting decision are available for review at the Region 4 office
and persons wishing to inspect the file must contact the Department representative listed
below to make an appointment to review the subject file. The Department will endeavor
to make the file available within two business days of contact, during normal business
hours (8:30 AM through 4:45 PM), unless the requester wishes to inspect the file at a
later date.
The Department will evaluate
any comments received regarding this proposed permit
modification and if the comments that are received raise significant new issues or provide
additional relevant information, the Department may modify the draft Air State Facility
permit and may decide to hold a public hearing. A copy of the Department’s permit
