Project Title: Availability of Voluntary Cleanup Project Remedial Action Work Plan for Comment, Former Maspeth Substation, Site No. V00326-2

Brief Project Description: The Site was formerly an electrical substation which housed transformers and other PCB-containing equipment. Operations ceased in 1988. Site investigations conducted prior and after implementation of the Voluntary Cleanup Agreement revealed the presence of transformer oil contaminated with polychlorinated biphenyls (PCBs). An Interim Remedial Measure consisting of the excavation and removal of PCB-contaminated soil took place prior to the sale of the property in 1996. An additional Interim Remedial Measure consisting of removal of PCB-contaminated NAPL from monitoring wells on the Site began in October 1999 and is on-going.

Notice of Rescheduled Public Scoping Meeting

Project Title: Hunts Point Water Pollution Control Plant Phase III Upgrade

Brief Project Description: The New York City Department of Environmental Protection (NYCDEP) is postponing the public scoping meeting on the Draft Scope of Analysis for the Phase III Upgrade for the Hunts Point Water Pollution Control Plant (WPCP). The public scoping meeting was originally scheduled for January 4, 2005. No meeting will be held on this date. Instead, NYCDEP will hold a public scoping meeting on the Draft Scope of Analysis on a later date, as yet to be determined. NYCDEP will provide notice of the rescheduled scoping meeting date as soon as it is scheduled. Please contact Crystal Johnson with any questions or to obtain a copy of the Draft Scope of Analysis (see below).

upon application and investigation has satisfied the requirements of 6 NYCRR Part 232, §232.3 Variances.

§232.3 Variances, allow Perchloroethylene Dry Cleaning Facility owners who meet the specific requirements of this section to petition the Department to be relieved of certain Part 232 requirements. In this instance, Mr. Daniel Tran, Partner of S. Kohan French Cleaners sought a §232.3 Variance in relief of the §232.6 requirement to install only new fourth generation equipment at an existing facility. In particular, in January 2002 S. Kohan French Cleaners purchased and installed a used COLUMBIA, model MEC 340/2F, S/N 99K3501, fourth generation perchloroethylene dry cleaning machine. At that time a used, refurbished fourth generation machine was considered "as new" pursuant to a then current DEC policy interpretation which was rescinded on May 28, 2003. Please see the PUBLIC NOTICE on this policy matter published in the May 28, 2003 edition of the New York State Environmental Notice Bulletin.

The Department grants S. KOHAN FRENCH CLEANERS, 73-17 Main Street, Flushing, NY 11367; DEC ID 2-6306-00727, a variance from the requirements of 232.6 and 232.16 for this one instance. This variance shall be maintained by operating the facility in full compliance with Part 232 and any and all other applicable regulations.

Positive Declaration And Public Scoping

New York City County - The Office of the Deputy Mayor for Economic Development and Rebuilding, as lead agency has determined that the proposed 270 Greenwich Street Mixed-Use Development may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. A public scoping session will be held on January 5, 2004, at 6:00 p.m. at the NYC Economic Development Corporation, Conference Room 4A/B, 110 William Street, 4th Floor, New York, New York. The action involves an approximately 1.1 million gross square feet of development, including a rental apartment building, which is expected to include an affordable component, a residential condominium building, approximately 170,000 gsf of ground-floor and second-floor retail, and below-ground parking for up to 400 vehicles. The site is Lot 110, Block 142 in the borough of Manhattan on the west side of Greenwich Street between Chambers and Warren Streets. The street address is 270 Greenwich Street.
