The Department (DEC) has
prepared a Draft Permit and has made a tentative
determination to approve this application for renewal of an existing Title IV (Phase II
Acid Rain) Permit as required by CFR Part 72 for the applicant's Dunkirk Steam
Generating Station located on the shore of Lake Erie. The electrical generating facility
consists of four pulverized coal, tangentially fired boilers that produce steam, which turn
steam turbine/generator sets to produce electricity for the grid. The facility can produce a
total of 600 megawatts of electricity during maximum production. Renewal of the Title
IV Permit will allow the US Environmental Protection Agency (EPA) and DEC to
continue to enforce the requirements of the Acid Rain Program. Emissions will not
increase as a result of the permit renewal. Prior permits, including the Title V Air Permit,
issued to this facility remain in force and also include sulfur and nitrogen oxide
requirements. The Title IV Draft Permit requires: possessing sufficient sulfur dioxide
(SO2) allowances to cover SO2 emissions from this facility; meeting NOx emission rates;
submitting annual compliance certification reports to EPA and DEC and monitoring,
maintaining and certifying monitoring systems for opacity, SO2 emissions, NOx
emissions, carbon dioxide and/or oxygen emissions, and volumetric flow rates in
accordance with the requirements of 40 CFR Part 75. In accordance with 6 NYCRR
Parts 621 and 201, the Administrator of the EPA has authority to bar issuance of this
permit if it is determined not to be in compliance with the applicable requirements of the
Clean Air Act or 6 NYCRR Part 201. The Draft Permit and application are available for

and DEC Allegany Sub-Office, 182 East Union, Ste. 3, Allegany, New York 14706.

The applicant proposes installation
of a water distribution system to serve the newly
created Town of Colden Water District No. 1 and the taking of a supply of water in
amounts estimated to average 78,000 gallons per day (maximum daily demand of 147,600
gpd) from the Erie County Water Authority (ECWA) via facilities of the Town of Boston
East Hill Water District No. 3 which is served by ECWA under the terms of a Lease
Management Agreement. This new water district will serve a total of 246 parcels in the
Town of Colden, initially as a bulk service customer of ECWA, however, it is anticipated
that the Town will eventually enter into a Lease Management Agreement with ECWA.
The project is to include installation of 35,000 linear feet of 8 inch and 10 inch
watermain, fire hydrants and related appurtenances. Approximately 20 top-mounted light
standards will be added along public right-of-ways in the Town's central hamlet area
during the same timeframe as the development of the water distribution system.
