Project Description:
The Department has made a tentative determination to approve an
Air State facility permit modification application for an existing Title V facility. This Air State Facility permit is to construct and operate a new 32.6 MM Btu/hr boiler operating on dual-fuel natural gas and #6 fuel oil. In order to cap out of PSD, 40 CFR 52.A.21, the new boiler will be limited to firing 1.5 MM gpy of #6 oil and 80 MM cubic ft. per year of natural gas or any combination not to exceed 46 tpy of NOx emissions. This boiler will replace the three existing boilers. Based on fuel consumption and emission calculations this is not a source project and is not subject to New Source Review Part 231 (Netting Analysis). This facility is subject to NSPS regulations. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has made a tentative determination to approve this application for a new permit for a proposed withdrawal and discharge of up to 1.152 million gallons per day of treated groundwater into Norton Basin (Class I) via NYCDEP Outfall ROC-647 from a treatment system consisting of a Settling Tank at the applicant’s facility located in the Edgemere area of Queens where the applicant is constructing storm sewers and appurtenances.  A draft permit is available for inspection and comment at the regional office.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

Project Description:
The applicant proposes to construct an 80 foot by 23 foot structure containing four one-family attached houses with decks within the adjacent area of NYSDEC regulated Class I Freshwater Wetland NA 10 (Oakwood Beach). The proposed houses will be located a minimum of approximately 60 feet from the wetland boundary. The proposal also includes the improvement of a portion of Fairbanks Avenue with three inch asphaltic concrete on an eight inch dense graded concrete base. The proposed roadway improvements will be located approximately 30 feet from the wetland boundary. The applicant proposes to establish a vegetative buffer consisting of a double row of vegetation between the wetland and the development. The project site is located at the intersection of Fairbanks and Brook Avenue, Staten Island, Block 4691, Lots 23, 25, 26 and 27.
