The New York State Department of Environmental Conservation (Department) administers the Brownfield Cleanup Program. The Brownfield Cleanup Program is designed to encourage the remediation of contaminated properties known as brownfields for reuse and redevelopment. The Applicant identified above has submitted an application to participate in the Brownfield Cleanup Program. The application was determined to be complete by the Department and is currently under review for eligibility. The property described in the application is identified by the Site Name and Site Number identified above and is located at the address above. The application proposes that the Applicant will conduct investigation and/or remedial activities at the site, to allow for commercial use of the site.
The Department will accept public comments concerning the application, as well as copies of a Phase I Environmental Site Assessment dated March 31, 2003, a Phase II Environmental Site Assessment dated October 2, 2003, groundwater quality data dated September 9, 2004, and a Toxics Targeting Computerized Environmental Report dated August 6, 2004 for thirty days from December 1, 2004 through December 31, 2004. After review of the application and any public comments received, the Department will determine whether to accept the Applicantís request to participate in the Brownfield Cleanup Program. If the Department accepts the Applicantís request to participate, it will execute a Brownfield Cleanup Agreement (BCA) with the Applicant. By executing a BCA, the Applicant would commit to undertake the project under the Departmentís oversight. The Department will require the Applicant to inform and involve the public during this process. The applicationís attached documents in the repository have not been reviewed by Department staff prior to their release for public comment. The Department, in conjunction with the New York State Department of Health, will review these documents during the public comment period.

Brief Project Description: The New York City Department of Environmental Protection (NYCDEP) is declaring lead agency status for the purposes of conducting an environmental review of the proposed Phase III Upgrade for the Hunts Point Water Pollution Control Plant (WPCP). NYCDEP has determined that the Phase III Upgrade is appropriate for analysis within the context of an EIS to permit the highest level of community involvement in the decision-making process. Therefore, NYCDEP is issuing a Positive Declaration and will prepare a Draft Environmental Impact Statement (DEIS). NYCDEP has issued a Draft Scope of Analysis. NYCDEP is proposing to make improvements to the Hunts Point WPCP located in the Hunts Point section of the Bronx. The proposed upgrade, Phase III in a three-phase program, involves construction and upgrading to improve solids handling facilities. The Phase III Upgrade is needed to replace facilities that are nearing the end of their useful life and to provide enhanced odor control. The Phase III Upgrade requires construction on an additional 5.5-acre vacant parcel of City-owned land located to the northwest of the existing plant boundary. The Phase I and Phase II Upgrades are separate and independent actions and are currently under construction. Separate Environmental Assessments were prepared for the Phase I and Phase II Upgrades.
The project may be subject to several potential State and City approvals including the following: financing under the State Revolving Fund Program, which requires review under the State Environmental Review Process (SERP); approval by the New York State Department of Environmental Conservation (NYSDEC) of a modification to the existing facility air permit (DEC ID 2-6007-00025/02005); waterfront revitalization (coastal zone) consistency determination from the New York State Department of State (NYSDOS); and the New York City Uniform Land Use Review Procedure (ULURP) site selection action to approve the siting of a public facility (i.e., the Hunts Point WPCP) on an additional 5.5 acres.
