     Palumbo Sand & Gravel. Inc. has applied for a modification of its existing Mined Land Reclamation permit to create an 18-acre pond on the east side of the Swamp River in a previously approved portion of their mine.   The pond would be as much as 55 feet deep, most of which would be into groundwater.  The Department has determined that these mining operations are considered actions “undertaken or approved” prior to the effective date of the State Environmental Quality Review Act (“SEQRA”) and have continuously occurred since the 1960s.  They are therefore considered grandfathered under SEQRA.

     The mine is located on a 155-acre parcel east of the intersection of NYS Rt. 22 and Sherman Hill Road in the Town of Dover, Dutchess County, NY.

    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 51,500 gallons per day of treated sanitary waste to a tributary of Wappinger's Creek.

Construct an approximately 60 x 25 foot boathouse, 25 feet into the water and 35 feet on upland, with a deck on the second story of the boathouse on Lake Mahopac (Water Index Number31-P44-14-P53, Class A).  The proposed project is located at 272 East Lake Boulevard, Mahopac, NY.

The applicant proposes to install a pre-fabricated, 16 foot wide concrete matting boat ramp extending 80 feet out into the Tidal Wetland of Piermont Marsh in the Hudson River.  The proposed boat ramp will be used by the Village of Piermont Fire Department and the NYS DEC, Department of Fisheries.  The installation of the ramp will be located on the northern side of the Piermont peninsula, approximately550 feet inland (west) from the end of the concrete pier.           

The Department has made a tentative determination to approve this application for a SPDES permit to discharge a maximum volume of 30,000 gallons per day of treated sanitary wastewater from Camp Chayei Sura into a tributary to Mill Brook [DEC Water Index D-16-2; Class B(t)].  Camp Chayei Sura is an existing facility located on High Street (CR#41) in the Hamlet of Glen Spey, approximately 0.6 miles south of the intersection with CR #31.  The permittee will be required to maintain records to verify compliance with the SPDES permit conditions and discharge limits.  A draft SPDES permit (SPDES No. NY0036064) is available for review at the NYSDEC Region 3 office.

    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 2,200 gallons per day of treated sanitary waste to a tributary of the Esopus Creek.

The applicant proposes to improve an existing access road across State-designated Freshwater Wetland PO-4 (Class III) to provide access to a proposed six-lot residential subdivision.  The project site is a 58-acre parcel of land located on the south side of Chapel Hill Road, immediately east of the intersection with Vineyard Avenue.  A 20-foot wide paved road is proposed, which will involve filling approximately 372 square feet (0.01 acre) of the wetland and 0.63 acre of the 100 foot adjacent area.  A stormwater pollution prevention plan has been prepared in accordance with the SPDES General Permit for Stormwater Discharges from Construction Activities (GP-02-01).

    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 19,800 gallons per day of treated sanitary waste to a Coxing Kill tributary.
