ENB Region 9 Completed Applications 11/17/2004

The Department has made a tentative determination to approve a modification to the existing  permit (NY0269344) and has prepared a draft permit which is available for review at the regional office. The applicant proposes to discharge 300 gallons per day (gpd) of treated sanitary wastewater to tributary 31 of Cattaraugus Creek. The new total discharge from the facility which is located on Henrietta Road between Scoby Road and State Rte. 219 would be 1,500 gpd. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. The applicant proposes to install a steel sheet-pile breakwall along approximately 112 feet of 270 feet of shoreline on his property to prevent further erosion.  The project site is at the facility listed above that is located along Chautauqua Lake, just northwest of Prendergast Point.
