    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 1,000 gallons per day of treated sanitary waste to a tributary of the Wappinger's Creek.

The applicant proposes to construct additional parking and a stormwater detention basin partially within the 100-foot adjacent area of State-designated Freshwater Wetland TH-13 (Class II).  The project site is located at the existing Barr Laboratories facility on Quaker Road.  The project  involves the re-grading and surfacing approximatley 0.51 acre of an existing gravel parking area for new parking and re-grading of approximately 0.33 acre of the 100-foot adjacent area for construction of a new stormwater detention basin.

    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 19,800 gallons per day of treated sanitary waste to Middle Mongaup River.

This is a mass modification, in accordance with New York State Department of Environmental Conservation Technical & Operational Guidance Series 1.2.2 and 6 NYCRR Part 750-1.18 (b)(7).

The United States Environmental Protection Agency (EPA) has recently promulgated effluent limitations guidelines and new source performance standards for the Concentrated Aquatic Animal Production (CAAP) Point Source Category at 40 CFR Part 451. This point source category consists of facilities with Standard Industrial Classification (SIC) codes of 0921 and 0273, i.e. fish farms and fish hatcheries. The following SPDES permit is affected by the new regulation and has been modified, en masse with all other fish hatcheries in NYS, to comply with the federal regulations:

The federal regulations require that the SPDES permits for all CAAP facilities include specific reporting requirements, including reporting of: use of investigational new animal drugs; failure in, or damage to, the structure of an aquatic animal containment system resulting in an unanticipated material discharge of pollutants to waters of the state; and the spill of drugs, pesticides or feed that results in a discharge to waters of the state. All of the 18 SPDES hatchery permits in NYS now include these reporting requirements.

The federal regulations also require that CAAP facilities that produce over 100,000 pounds per year of fish be required to develop, maintain, and implement a Best Management Practices (BMP) plan to prevent releases of significant amounts of pollutants to the waters of the state. Four of the eighteen facilities produce over 100,000 pounds of fish per year. They are: Caledonia, Catskill, Rome and Salmon River fish hatcheries. These four SPDES permits were modified to include the requirement to develop BMP plans.

The applicant proposes to construct a new 10-foot high earthen dam replacing a failed dam to restore a 17-acre lake called "Knickerbocker Pond". The location is within a tributary of Sprague Brook northeast of the intesection of Grooville Road with White Roe Lake Road.

    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 20,000 gallons per day of treated sanitary waste to Chodikee Lake.

The applicant proposes to subdivide an existing 208-acre parcel of land into two lots of 10 acres and a third remaining lot of approximately 188 acres.  The site is located on the east side of Sax Road, approximately 0.4 mile north of the intersection with Wallkill Avenue.  Two, single-family residences will be constructed on the newly created 10-acre lots.  The existing agricultural use of the remaining 188-acre lot will continue.

    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 25,000 gallons per day of treated sanitary waste to a tributary of the Mianus River.

The applicant proposes to install two, additional 30,000 gallon water storage tanks within the 100-foot adjacent area of State-designated Freshwater Wetland L-17 (Class II).  The project site is located within the Michelle Estates subdivision at the end of Avery Road. The project will involve the filling approximately 0.08 acre of the 100-foot adjacent area. Upon completion, the water storage facility will consist of four, 30,000 gallon water storage tanks.  The additional storage is proposed to only address exisiting operational inefficiencies of the system.  No increase in the proposed water taking is proposed.  

The Department has made a tentative determination to approve this application for a new SPDES permit for an existing surface discharge from an outfall (No. 001) with a maximum daily flow of 1200 million gallons per day (MGD) at Shaft 17 of the Delaware Aqueduct located at the Kensico Reservoir, Class AA. Outfall No. 001 currently reflects the routine transfer of approximately 864 MGD of drinking water from Rondout Reservoir and/or the West Branch Reservoir to the Kensico Reservoir as part of on-going drinking water supply operations for the City of New York. Outfall No. 001 is also the proposed injection point for sodium bisulfite, a dechlorinating agent, should water conveyed via Shaft 17 be chlorinated at a point upstream for water quality purposes. Dechlorination treatments would occur infrequently on an as-needed basis. The project involves the reconstruction of the site access road,  construction of new chemical supply facilities, a stormwater detention basin with outfall to the reservoir,  and rip-rap embankment protection on an earthen dike within the reservoir.  The project is located west of the intersection of Weber Place and Cooney Hill Road in the Town of North Castle, Westchester  County. A draft SPDES permit is available for inspection and comment at the regional office.  NOTE:  The draft SPDES permit prepared for this facility does not authorize operation of the Chelsea Pump Station; the permittee must obtain a Water Supply permit from DEC prior to operation of the Chelsea Pump Station.
