The Department has prepared a draft permit and has made a tentative determination to approve this Air State Facility application for an existing Title V facility. The applicant is planning to shut down and remove one 150 MM Btu/hr boiler and install a new 137.8 MM Btu/hr Nebraska NSX G-87 boiler. The facility is capping out of 40 CFR 52-A.21, PSD in terms of sulfur dioxide by limiting the yearly emissions to under 100 tons (95 tons for any twelve consecutive months.)  The proposed boiler replacement project is not subject to New Source Review for either NOx or VOC. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

The applicant proposes to restore and enhance approximately 15 acres of tidal wetlands marsh in the Bridge Creek Wetland System. The project involves regrading of areas to allow tidal inundation, removal of invasive Phragmites and replanting the area with native high and low tidal marsh plant species. The project is located along Bridge Creek at Western Avenue, Staten Island.

The applicant proposes to subdivide Block 6442 - Lot 126 and construct one new detached two-family house including concrete parking pad and sidewalk. A new four foot split rail fence will be constructed between the developed area and the wetland. The project site is located within the adjacent area of NYSDEC regulated Class I Freshwater Wetland AR-13 (Blue Heron Park - South). The project site is located on Newton Street, Staten Island, Block 6442 - Lot 126.   

The applicant proposes to construct a new 800 square foot extension to an existing house and new a 200 square foot extension to an existing garage. The project site is located within the adjacent area of NYSDEC regulated Class I Freshwater Wetland AR-13 (Blue Heron Park - South). The project site is located at 37 Newton Street, Staten Island, Block 6442 - Lot 134.   

The applicant proposes to demolish an existing house and construct a new one-family detached house including swimming pool, sidewalk, driveway, deck and drywells. The project site is located within the adjacent area of NYSDEC regulated Class I Freshwater Wetland NA-7 (South Beach). A deed restricted vegetated buffer area is proposed to be established between the wetlands and the developed area. The project site is located at 86 Pearsall Street, Staten Island, Block 3417 - Lot 143. Since the project site is located within the adjacent area of Freshwater Wetlands NA-7 it is included a current moratorium which prohibits NYSDEC from issuing a permit for this project until conclusion of the moratorium.
