The
applicant proposes discharge of approximately 30 gallons per day of treated floor
drain wastewater to groundwaters (Class GA) from an oil/water separator treatment
system at the applicant's proposed facility located at Jones Pond Road near its intersection
with NY Route 86. The new discharge is for the replacement Town of Brighton
Highway Garage.
The
Department has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project.

Proposed impact to 0.13
acre of Freshwater Wetland T-12 (class II) and 0.96 acre of
wetland adjacent area, associated with roadway and utility construction for the new 69 lot
Farmview Residential Subdivision. As mitigation, 0.70 acre of on-site wetland will be
created. Work includes a stream culvert extension in a tributary of the Hudson River
(Class C(TS)). The project is located to the east of Harris Road, one mile south of Lower
Newtown Road, Town of Halfmoon.
