Safety Kleen Systems, Inc.,
formerly Safety Kleen Corporation, is a solvent distributor
and recycler (reclaimer). Its customers are primarily engaged in automotive repair,
industrial maintenance and dry cleaning. The company offers spent solvent collection
and reclamation. The facility operates under the state 6 NYCRR Part 373 hazardous
waste management permit issued on September 27, 1999. The permit was due to expire
on September 27, 2004, but Safety Kleen applied for permit renewal on March 24, 2004,
so the existing permit will be extended pursuant to the State Administrative Procedures
Act, Section 401(2), until the Department makes a determination on the renewal
application. The area is zoned for commercial use and the facility is located in a
business/industrial park. The majority of this facility's customers generate less than 1000
kg (2200 lbs.) per month of hazardous waste. Wastes managed by Safety Kleen Systems
are transported in its transport vehicles to one of Safety Kleen’s Recycle/Process Centers
or to contract reclaimers located outside New York State. The recovered solvents are
returned to customers as usable product. Safety Kleen Systems also store hazardous
wastes for less than 10 days incidental to transportation. This incidental storage is exempt
from the hazardous waste regulations and regulated under the Code of Federal
Regulations Title 49 pertaining to Hazardous Materials Transportation. However, such
storage is limited to 10 days or less. These 10-day storage areas at the facility are
designated as Area South and Area North. The recyclable waste solvents generated by
the Parts Washer Services, which is the primary business of the facility, will be collected
by Safety Kleen’s own transport vehicles and stored in the permitted tank prior to
transportation to the Recycle centers in tanker trucks. Containerized spent parts washer
solvent routed to the facility will remain on the transport vehicles for a limited time prior
to it being transferred into the bulk storage tank through the fully enclosed Return and Fill
station or transferred to two permitted staging/storage areas located at the Return and Fill
Station building. Safety Kleen stores in the permitted storage tank three types of spent
cleaning solvents: ignitable solvents, water-based solvents and solvents with a high flash
point which are not classified as ignitable under the Department regulations. All these
wastes derived from these commingled solvents are managed as hazardous wastes. All
ignitable wastes at the facility will be stored 50 feet from the facility property line.
Interested persons with reasonable concerns about the draft permit can raise all
reasonably ascertainable issues and submit, in writing, all available arguments and factual
grounds supporting their position to Ms. Nancy Adams at the above address before the
last filing date. A mailing list will be maintained for this facility. The public can submit a
written request to the above contact person to put on the mailing list. In lieu of, or in
addition to, the submission of comments as stated above, any interested person may
request a Public Hearing. Any request for a public hearing must be made in writing,
stating the nature of the issues proposed to be raised in the hearing and submitted to the
above-mentioned person no later than the last filing date. The draft permit, the
