Title: NYS Department of Environmental Conservation, Division of Environmental Remediation, Draft Brownfield Cleanup Program Eligibility Determination Guidance

Subject: Draft Program Policy

Description: The New York State Department of Environmental Conservation (the "Department") has prepared a draft of revisions to Subsections 2.1, 2.2 and 2.3 of the Draft Brownfield Cleanup Program Guide ("BCP Guide") that was noticed for public comment on May 12, 2004. Public comments on the BCP Guide were accepted through July 12, 2004. The comments received are currently being evaluated.

The referenced subsections deal with eligibility for entry into the Brownfield Cleanup Program. The Department has made significant revisions to those subsections and so has determined it is appropriate to seek public comment on the revised draft before it is incorporated into the final BCP Guide.

Comment Period: Comments on this action will be accepted for 30 days following publication in the ENB. The last day for receipt of comments will be 11/19/04. Comments should be sent to the individual identified in this notice. Any questions should also be directed to this individual.

Clean Water State Revolving Fund (CWSRF) for Water Pollution Control
Final FFY 2005 Intended Use Plan (IUP)

The New York State Environmental Facilities Corporation (EFC) and the Department of Environmental Conservation (DEC) have prepared the final Federal Fiscal Year (FFY) 2005 Intended Use Plan (IUP) for the Clean Water State Revolving Fund (CWSRF). The IUP includes a list of projects that could receive low interest financing between October 1, 2004 and September 30, 2005.

New projects may be added to the IUP Annual and Multi-Year Project Priority Lists as they are identified by municipalities and not-for-profit land acquisition organizations interested in CWSRF financing, subject to availability of sufficient funds. Notification of amendments to the final IUP will also be published in the Environmental Notice Bulletin (ENB).

Copies of the final 2005 CWSRF IUP are being mailed to certain municipal officials, advisors, consulting firms, and other interested parties. Copies are also available at New York State Documents Depository Libraries. The CWSRF IUP is available on the EFC ďweb pageĒ at www.nysefc.org/clean water/2005 IUP - final IUP.
