ENB Region 1 Completed Applications 10/13/2004

Install temporary dewatering system for the installation of new nitrogen removal facilities at the Oyster Bay Sewage Treatment Plant.    A total of 3 wells are proposed, each 12" diameter, with an estimated daily pumpage of 2.16 million gallons per day.   Water will be discharged into the surface waters of Oyster Bay.   Prior to discharge,  dewatering effluent  will be treated with an air stripping system for the removal of  contaminates.

The applicant proposes to remove two existing boat ramps and a groin, construct two new boat ramps and a timber groin, dredge a portion of Hempstead Harbor used as the approach channel to the boat ramps to a depth of 4' below apparent low water, place the beach compatible dredge material on the adjacent beach, and grade the beach.   The total amount of material to be dredged is estimated to be 9,400 cubic yards.  Hempstead Harbor is considered a NYSDEC regulated tidal wetland.  The project is located at Tappen Beach Marina, Shore Road, south of Littleworth Lane, Glenwood Landing, Town of Oyster Bay, Nassau County.

The applicant proposes the construction of a new single family dwelling with septic system and driveway.  The proposed project will be located in the adjacent area of NYSDEC regulated Freshwater wetland B-1.   The septic system will be located greater than 100 linear feet from the Freshwater wetland.  The project is located at 26 Adams Avenue, Wyandanch.  SCTM# 100-41-3-9.

The Department has prepared a Draft Permit and has made a tentative determination to approve this application for the existing generating facility on Buell Lane w/o Cove Hollow Lane, East Hampton.  The facility consists of three diesel generators and a single combustion turbine maintained to meet regional load demand and emergency power requirements.

In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.  It is recommended that an appointment be made to confirm the availability of the subject files.  The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.  A public hearing may be legislative or adjudicatory.  A legislative public hearing is a proceeding which provides an additional opportunity for public comment.  DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists.   If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments.   The applicant and all persons who  have filed comments on the permit will be notified by mail of the public hearing.  Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination.  An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.   A copy of the Department's permit hearing procedures is available upon request or on the Department web site at: http://www.dec.state.ny.us/website/ohms/gudph1.htm.

The applicant proposes to subdivide a 93,114 sq. ft. parcel into two lots of 48,384 and 47,730 sq. ft. each.  The demolition of an existing dwelling and the construction of a new dwelling were authorized at this site by NYSDEC Permit# 1-4736-01748/00001. Regulated tidal wetlands exist on the property.  The purpose of the project is to provide two lots for residential development. The proposed project is located at 271 Asharoken Avenue in the Village of Asharoken, Town of Huntington, Suffolk County, SCTM# 401-07-02-01.

             

The applicant proposes to resheathe 95 feet of bulkhead, place 30 cubic yards fill material behind the bulkhead as backfill and revegetate the fill area.  Apparent high water is located landward of the bulkhead in some areas.  The project will result in the loss of approximately 228 square feet of tidal wetlands known as littoral zone (SM/LZ).  The applicant also proposes to install a two pile boat lift at the bulkhead.  The project is located at 30 Bayview Walk, Seaview, Town of Islip, Suffolk County, SCTM# 0500-479-1-58.  

THE APPLICANT PROPOSES TO SUBDIVIDE A 4.6 ACRE PARCEL INTO TWO LOTS.  LOT #1 IS PROPOSED TO BE 3.2 ACRES IN SIZE AND THE EXISTING DWELLING IS TO REMAIN.  LOT #2 IS PROPOSED TO BE 1.4 ACRES IN SIZE AND FUTURE DEVELOPMENT WITH A DWELLING IS PROPOSED. REGULATED TIDAL WETLANDS ARE ON OR NEAR THIS PARCEL OF LAND. THE SITE IS LOCATED AT SOUND ROAD, WADING RIVER, TOWN OF RIVERHEAD, SUFFOLK COUNTY, SCTM#600-35-3-10.4.

The applicant proposes to remove and replace, in-place, 75 linear feet of bulkhead and two 12 ft. returns.  Dredge not greater than 20 ft. seaward of the replacement bulkhead to a maximum depth of 3 ft. below mean low water.  Resultant 15 cubic yards of dredged material to be used as backfill and 45 cubic yards to be trucked to an approved upland location.  Also, remove and replace a 3 ft. by 13 ft. ramp and 3 ft. x 62 ft. of floats secured by five (5) pilings.  The property is located at 9 Washington Drive, Hampton Bays, Town of Southampton, County of Suffolk.

Applicant proposes to lenghten an existing 85' canoe/kayack dock by 22 feet with the addition of four floats, the largest measuring 10' x 40'. The applicant also proposes the installation of a new "H" configured dock measuring 100' in length  with two 20' fishing platforms  The project is located at the Peconic Dune County Park at 6375 Soundview Avenue Peconic on Great Pond, Town of Southold.
