6NYCRR Part 40 Notice of Emergency Adoption

Pursuant to the Environmental Conservation Law, Sections 13-0340-b, 13-0340-e and 13-0340-f, the Department of Environmental Conservation hereby gives notice of the following:

Notice of Emergency Adoption of 6NYCRR Part 40 relating to marine fish. This notice will be published in issue 41 of the State Register, dated 10/13/2004 and was effective upon filing on 9/27/2004.

Negative Declaration

Nassau County - The New York State Department of Environmental Conservation, as lead agency, has determined that the proposed Tappen Beach Marina Project will not have a significant adverse environmental impact. The action involves a reconstruction of an existing boat ramp, dredging and the placement of dredged material on beach, construct groin. The project is located in the Town of Oyster Bay.

Positive Declaration

Suffolk County - The New York State Department of Transporation, as lead agency, has determined that the proposed Route 347 Reconstruction, Northern State Parkway to Route 25A may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a reconstruction project on Route 347 which proposes an eight lane arterial from Northern State Parkway to Route 454 and a six lane arterial east of Route 454 to Route 25A. The project proposes to grade separate the intersections of Route 347 with westbound Route 454, Route 25 and Nicolls Road and also proposes two new ramps on Northern State Parkway at New Highway. The total length of the project is approximately 24.0 km (15.0 miles).
