The applicant has applied for a Part 360 permit to operate a 450 ton per day (tpd) construction and demolition (C & D) debris processing facility located partially within the 100 foot adjacent area of Freshwater Wetland PK-5 (Class II) on an 8.7-acre parcel. The facility was formerly operated as a ready-mix concrete plant by the applicant, Mid-Hudson Structural Concrete, Inc. The applicant has a current DEC registration (#14W04) to operate a C & D processing facility at the site, although operations were never initiated under the registration. There will be less than 0.01 acre of disturbance to the buffer area of the wetland as a result of this project in order to construct a stockade fence and a one foot high curb to prevent intrusion into regulated areas of the wetland. The project is located on the southeast side of Van Wagner Road, approximately 1000 feet east of Tucker Drive in the Town of Poughkeepsie, Dutchess County.

The applicant proposes to fill approximately one acre of federal jurisdictional wetland in conjunction with construction of a taxiway (for safety purposes) adjoining the existing runway at Kingston-Ulster Airport. As mitigation, 0.85 acres of wetland will be created at "Burnt Swamp', located at State-regulated Freshwater Wetland # RD-1 (Class: 2) approximately 7 miles southwest, and additional enhancements will be made for use as an environmental education facility. The airport is located northeast of the intersection of Routes 199 and 32.
