Statewide - The New York State Office for Technology (“OFT”), Statewide Wireless Network Project Office, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed New York Statewide Wireless Network (“SWN” or “Network”). Brief Description of Action: OFT proposes to develop the SWN for voice and data radio communications services to enable public safety and public service entities operating within the State of New York to better respond to and protect our citizens. The SWN will provide essential connectivity to coordinate the delivery of governmental services to the citizens of New York, and to enable immediate coordination of public safety resources in emergency situations to ensure the public’s safety and welfare. The proposed SWN project is fundamentally an infrastructure, a collection of radio sites throughout the State interconnected by a network, monitored and controlled by a pair of redundant operations centers.
The proposed action is the deployment of the SWN, which includes the Primary Regional Build Out, Final Engineering Design, Statewide implementation involving the Construction and Operation of the Network and Ongoing Maintenance of the SWN.
Location of Action: A generic environmental impact statement has been completed by OFT because the exact locations of the SWN antenna facilities and operations centers (“Network Facilities”) have yet to be determined. OFT expects that the SWN project will involve the establishment of Network Facilities in locations across New York. The eventual locations for the Network Facilities will be selected to avoid, to the extent practicable, previously undeveloped sites. The use of existing State-owned infrastructure and properties will be a priority in determining the locations of the SWN antenna facilities and operations centers.

Proposed Commissioner Policy Concerning
On-site Environmental Monitoring
The New York State Department of Environmental Conservation (Department) has proposed a Commissioner Policy that describes the Department’s policy regarding the on-site environmental monitoring of entities or facilities subject to the Department’s regulation or oversight. It also describes procedures to be followed when placing a monitoring requirement on an entity or facility.
Copies of this proposed Policy may be obtained by contacting the person indicated below. Written comments on this proposed Policy are welcomed and should be sent to the contact person listed below within 30 days after this notice appears. The Department has prepared a draft Enforcement Guidance Memorandum (EGM) that would revise and supercede Commissioner’s Policy DEE-18, entitled "Spill Site Remediation Under Department Order" and dated December 18, 1995. DEE-18 established the policy and procedures governing the Department's use of Stipulation Agreements to expedite the remediation of petroleum spills. This draft EGM reiterates the goal of remediating petroleum spills expeditiously and, among other modifications, enhances the policy and procedures contained in DEE-18 in the following ways:

New York State Department of Environmental Conservation 6 NYCRR Part 218, Emission Standards for Motor Vehicles and Motor Vehicle Engines

Emergency Adoption amending 6 NYCRR Part 200, General Provisions, and Part 218, Emission Standards for Motor Vehicles and Motor Vehicle Engines, to incorporate modifications that California has made to its vehicle emission control program relating to the ZEV mandate to reduce emissions in New York State and to make revisions to New York State’s alternative compliance plan.
This amendment, necessary for the preservation of the health and general welfare, was adopted and effective upon filing with the Department of State on the 17th day of September, 2004, on an emergency basis as authorized by section 202(6) of the State Administrative Procedures Act.

Notice of Adoption of Rule on September 20, 2004, to be effective October 22, 2004: amendments to 6 NYCRR Part 201, Permits and Certificates.
The adoption of this rule corrects an inconsistency between 201-3.2(c)(39), which purports to exempt such sources from Part 201 requirements, and 201-4.1(a)(3). According to paragraph 201-4.1(a)(3), facilities which emit Hazardous Pollutants and are not otherwise required to obtain a permit must obtain a minor facility registration. This amendment clarifies that conveyorized and open top degreasers that are subject to 40 CFR 63, Subpart T are not exempt sources.

The Department is seeking input on the development of a new environmental leadership program, which will be called New York Environmental Leaders. New York Environmental Leaders will be a voluntary program focused on encouraging Environmental Management Systems, beyond compliance performance, pollution prevention, and sustainable business practices. The Department will encourage participation by providing recognition and incentives to those organizations that are able to demonstrate that they meet the requirements for entering New York Environmental Leaders. The framework for New York Environmental Leaders is established in a recently issued Commissioner’s Policy on Environmental Management Systems (CP-34). However, many details still need to be established. In order to gather input on the details of this program, the Department is asking interested stakeholders to complete a survey.
