    The Department of Environmental Conservation (DEC) has received an application to re-issue and modify the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and to modify the permit to add additional monitoring and reporting requirements.  This permit involves the surface discharge of up to 200,000 gallons per day of treated sanitary waste to the Fishkill Creek.

The applicant proposes to modify a portion of the 100 foot adjacent area of Freshwater Wetland WR-28 (Class II) in conjunction with the construction of a 21,000 square feet office/commercial facility, the Warwick Professional Park, on a15.8 acre parcel. The project includes demolition and removal of several existing structures, construction of seven buildings in two phases, and construction of associated septic disposal system, paved parking areas and drainage improvements.  Activity proposed within the adjacent area is construction of an outfall from the proposed stormwater detention basin with overland discharge to the Wawayanda Creek, Class B(t). No disturbance is proposed within the Freshwater Wetland and no disturbance to the stream is proposed. The total area of disturbance to the adjacent area of the wetland is approximately 0.04 acre. The project is located on the south side of Kings Highway (County Route 13), 500 feet east of Belcher Road in the Town of Warwick, Orange County. A stormwater management plan has been prepared and is available for review.

    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 33,000 gallons per day of treated sanitary waste to the Lemons Brook.

The applicant proposes to fill 0.03 acres of Freshwater Wetland # CD-57 (Class: 3) in conjunction with construction of a common 12-foot wide driveway serving 2 proposed new houses on 6 +/- acres of land. The location is on the north side of Patura Drive approximately 1/4 mile west of the intersection with Freetown Highway.

    Marbil Corp. proposes to mine sand and gravel from 26.5 acres out of a total site of 39 +/- acres (with the remaining acreage acting as a buffer).  The maximum depth of excavation is 25 feet and the total volume to be excavated over an estimated 15-year period is 425,000 cubic yards.  Mining and reclamation would occur in three phases, thus affecting a maximum of 10.5 acres at any given time (Phase I).  A dry screen is proposed to be used to screen and and sort the minerals.  The location is southwest of the intersection of Denniston Road with NYS Route 208.

    Upon review of all duly filed written comments and previously received oral comments, Department Staff will determine whether additional hearings about Applicant's proposal will be necessary.
