The applicant proposes to armor 200 feet of stream bank on West Canada Creek, a class C, standards C(T) trout stream. The project is located within a special regulation section (No-Kill) of this highly utilized trout fishery. Armoring will consist of heavy stone fill. The site has been subject to severe erosion.

The Department has made a tentative determination to approve an application for a modification of an existing SPDES permit (NY0002755) to discharge approximately 1.25 MGD of treated process waste water to a tributary of the Beaver River. The discharge is from an existing outfall (001) at the permittee's paper mill located in the Hamlet of Beaver Falls in Lewis County. The modification also includes the discharge of approximately 2700 GPD  of treated sanitary waste water (outfall 004) and various additional flows (intake water overflow, fire pump overflow and storm water) from other existing outfalls discharging to the Beaver River. The modification SPDES permit also includes a compliance schedule for ground water monitoring around the mill's waste water treatment lagoons and relocation of outfall 001 for the direct discharge to the Beaver River. The modification allows the paper mill to discharge treated process waste water during a full 24 hour production rate of 25 tons per day.

The applicant proposes to upgrade the French Road, located approximately 3 miles west of the hamlet of Martinsburg, to facilitate construction of the Flat Rock Wind Power Project.  The road will be widened 26' on the North side, resulting in the loss of approximately 11,300 square feet of federally regulated freshwater wetland.  Wetland impacts associated with the Flat Rock Wind Power Project are being mitigated through the creation of, and restoration of wetlands in the area.

The applicant proposes to upgrade the Graves Road, 2.5 miles west of the hamlet of Martinsburg, to facilitate construction of the Flat Rock Wind Power Project.  The road will be widened 22.5' on the east side, resulting in the loss of approximately 8700 square feet of federally regulated freshwater wetland.  Wetland impacts associated with the Flat Rock Wind Power Project are being mitigated through the creation of, and restoration of wetlands in the area.
