ENB Region 9 Completed Applications 09/08/2004

The applicant requests a one-year permit for the mining of generic soil materials with no on-site processing, for the purpose of a NYS Department of Transportation highway improvement project (Route 305).  The borrow site will affect 4 acres of land owned by Cuba Overseas Veterans Organization, Inc., VFW Post 2721, and will be reclaimed as a grass parking area.

The applicant proposes to provide additional capacity in Sanitary Sewer District #16 by installation of a 36-inch diameter PVC sanitary interceptor sewer to replace the existing 24-inch sanitary interceptor sewer that parallels North French Road.  The sewer line will transverse NYS regulated Freshwater Wetland TE-18 and its 100 foot-wide adjacent area. The project will complete the planned sewer replacement extending from the west side of the I-990 Expressway to Millersport Highway.

The Department has made a tentative determination to approve an application for modification of an existing permit which will change water treatment chemicals, delete an outfall and add an outfall into the U-Crest Ditch tributary of Scajaquada Creek.  A draft permit specifying effluent limitations and monitoring parameters is available for review.  The facility is located at 4455 Genessee Street.

The applicant proposes to lengthen a pre-existing stone driveway and construct a stone parking pad in the 100-foot adjacent area of NYS regulated Freshwater Wetland EA-2. The project is located on the south side of Clinton Street approximately 1/2 mile east of Town Line Road.

The applicant proposes to create 7.5 acres of varied wetland habitat as mitigation for impacts to 4.0 acres of federally regulated wetland during construction of a single family residential subdivision for 36 homes.  The mitigation wetland creation will be constructed within the regulated 100 foot wide adjacent area of NYSDEC regulated wetland TE-9.
