The applicant proposes a USDA/NRCS
wetland restoration and enhancement project
(WRP) to improve wildlife habitat in a 32.128 acre WRP easement, in a portion of
State regulated Freshwater Wetland #FI-1. The proposal includes rebuilding an
existing low-level berm on Wigwam Creek and installing a plastic sheet pile weir and
water control structure to maintain water levels within the WRP easement area. A
rock-lined channel will be installed at the downstream end of the weir to protect it and
to safely discharge runoff to the culvert under Burt Hill Road. The project site is
located on the north side of Burt Hill Road and west of Peavy Road in the Town of
Allen, Allegany County.

The applicant proposes installation and
development of a new water supply well (Well
No. 5) Well No. 5 has a design capacity of 150 gallons per minute (gpm) and will be
utilized as an auxiliary source to existing Well No. 4 (314 gpm) and Well No. 2 (162
gpm). The Town of Friendship Water District serves a population of approximately
1,380 people through 599 service connections including one large industry, Friendship
Dairies. Average daily demand is estimated at 81,630 gallons per day. The project site
is located on the east side of NYS Rt. 275, approximately 4,800 feet south of the
intersection of State Rt. 275 and County Highway 20. Well 5 will be located
approximately 60 feet from existing Well No. 4.

The applicant proposes a
discharge of 9,000 gallons per day of treated sanitary
wastewater via a surface discharge to Mutton Hollow Road Stream from the applicant's
facility located at 6619 Mutton Hollow Road in the town of Great Valley. The applicant
plans to upgrade the treatment plant with a rotating biological contactor and secondary
clarifier. The Department has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. The Department seeks
comments on the proposed regulated activity prior to making a final decision on permit
issuance. As such, this tentative determination does not signify Department approval for
or endorsement of the activity for which a permit is sought or for the overall proposed
