6NYCRR Part 41 - Notice of Adoption

Pursuant to the Environmental Conservation Law, Sections 13-0307 and 13-0319, the Department of Environmental Conservation hereby gives notice of the following:

Notice of Adoption for 6NYCRR Part 41 relating to the sanitary condition of shellfish lands. This notice will be published in issue 32 of the State Register, dated 8/11/2004.

Brownfield Cleanup Program

Pursuant to ECL 27-1407 and 1417

The New York State Department of Environmental Conservation (Department) administers the Brownfield Cleanup Program pursuant to ECL 27-1400 et seq. The Brownfield Cleanup Program is designed to encourage the remediation of contaminated properties known as brownfields for reuse and redevelopment. LC Main, LLC c/o Cappelli Enterprises, Inc. has submitted an application to participate in the Brownfield Cleanup Program. The application was determined to be complete by the Department on July 28, 2004. The property described in the application is located at 221 Main Street, White Plains, New York 10601. The application proposes that the applicant will conduct investigation and/or remedial activities at the site. The application proposes that the site will be used for commercial and residential purposes.

The Department will receive public comments concerning the application for thirty days from August 4, 2004 through September 3, 2004. After review of the application and any public comments received, the Department will determine whether to accept the Applicant’s request to participate in the Brownfield Cleanup Program. If the Department accepts the Applicant’s request to participate, it will execute a Brownfield Cleanup Agreement (BCA) with the Applicant. By executing a BCA, the Applicant would commit to undertake certain remedial activities under the Department’s oversight. A copy of the application as well as other related attached documents which includes a Phase I Environmental Assessment Report are available in the document repository for this site located at the White Plains City Library, 100 Martine Avenue, White Plains, Ne York 10601.

The referenced documents are draft and have not been reviewed by the Department staff prior to their release for public comment. The Department, in conjunction with the New York State Department of Health will review these documents during the public comment period.

Public Comment Period Extended

Westchester County - The City Council of the City of Yonkers has advised that the public hearing on the application below was closed on July 19, 2004. The written public comment period has been extended through and including August 14, 2004. The Ridge Hill Village Center is a proposed action consisting of amendments to the Yonkers Zoning ordinance, site plan approval and related permits to permit the construction of the Ridge Hill Village Center at 1 Ridge Hill in the City of Yonkers.

Notice Of Acceptance Of Draft EIS

Ulster County - The New York State Department of Environmental Conservation, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Marbil Corporation Mine. Comment period ends October 1, 2004. A hearing has been scheduled and the notice can be viewed here http://www.dec.state.ny.us/website/ohms/notices/marbil.html. Additional information about the project can be found in the Combined Notice of Complete Application. The action involves a proposed sand and gravel mine in three phases affecting a total of 26.5 acres. A dry screen is proposed to be used to screen and sort the minerals. The project site is located southwest of the intersection of Denniston Road with NYS Route 208, Town of Shawangunk, Ulster County.

Notice Of Acceptance of Draft Supplemental EIS

Orange County - The Town of New Windsor Planning Board, as lead agency, has accepted a Supplemental Draft Environmental Impact Statement on the proposed Patriot Estates Subdivision & Patriot Bluff Condominiums. The Comment Period ends August 4, 2004. The Public Hearing has not yet been scheduled. The action involves the site plan and subdivision approval to permit construction of a 28 lot subdivision to be known as “Patriot Estates” and a 96 unit condominium complex to be known as “Patriot Bluff Condominiums”. A draft scoping document has been prepared and is under consideration by the lead agency. The Planning Board will accept written comments on the draft scoping document up to and until 4:00 p.m. on August 4, 2004. The project is located on approximately 55 acres northwest of the intersection of Union Avenue and NYS Route 32 in the Town of New Windsor, Orange County, New York.
