The Department has received an Air State
Facility application from Baskin Livestock Inc,
for construction and operation of a facility to include a coal fired heater and rotary drier,
to process bakery waste into animal feed. The facility will be located at 9778 Creek
Road in the Town of Bethany, Genesee County.
As part of this application, Baskin Livestock
has proposed to restrict facility potentials to
emit volatile organic compounds (VOC) to below the 50 ton per year applicability
thresholds in 6 NYCRR Part 2016 (Title V) and Part 231-2 New Source Review in
Nonattainment Areas and Ozone Transport Regions. In response, the Department has
drafted Special Permit Conditions to limit operation of the coal fired burner to 2750
hours in any 12 consecutive month period, and that specify stack testing to verify or
modify the operating parameters necessary to restrict facility potential to emit VOC to
less than 50 tons per year.
To verify that the facility is in compliance
with these permit conditions, Baskin Livestock
will be required to maintain a log of monthly hours of operation, fuel use, 12 month
rolling totals of fuel use, calculate monthly emissions of VOC, NOX, and SO2,
and
calculate 12 month rolling totals of emissions. These records are to be maintained for a
minimum of five years, and must be made available with all supporting data to
Department inspectors upon request.

The applicant proposes a
discharge of approximately 80,000 gallons per day of treated
sanitary wastewater to Oatka Creek, a class C waterbody, from a proposed secondary
treatment plant, to be constructed northwest of the intersection of Routes 63 and 19, on
Woodrow Street, west of the Town Highway facility, in the Town of Pavilion. The
applicant proposes to install sanitary sewers and pump stations to serve the Hamlet of
Pavilion area. The project includes an outfall structure in Oatka Creek. The Department
has made a tentative determination to issue a SPDES permit and a Protection of Waters
Permit. As a tentative determination, the Department seeks comments on the proposed
regulated activity prior to making a final decision on permit approval. The file and draft
permit are available for review at the NYSDEC Region Office.

The applicant operates an
industrial facility located on Rt. 63 where they produce liquid
organic peroxides that are used primarily in the production of acrylics, elastomers, low
density polyethylene, polyesters, polystyrene and polyvinyl chloride. The Department
proposes to modify the referenced wastewater discharge permit based on a full technical
review. The proposed modification will delete several parameters based on monitoring
results and will add monitoring for other parameters. Acute toxicity testing requirements
will also be added and the flow basis will be decreased from 182,000 gallons per day to
86,000 gallons per day to reflect actual flows. The discharge enters the Genesee River, a
class C stream in the vicinity of this facility. The discharge will meet New York State
Water Quality Standards with the proposed discharge limits.
The Department has made
a tentative determination to approve this modification. As a
tentative determination, the Department seeks comments on the proposed regulated
activity prior to making a final decision on permit issuance. A draft permit is available
for review.

The Department has received a Mined Land
Reclamation application from Abram
Cleason Co Inc for modified operations at the Abram Cleason - Newark Pit. The
applicant proposes to add 8 acres to the existing 134.5 acre life of mine (LOM) area. A
total of 103.3 acres will be affected by mining operations during the next 5 year permit
term. 22.3 acres of the LOM area have been approved as reclaimed by the
Department. Excavation will not be below the local water table in the 8 acre expansion
area. The project site is located on the Abram Cleason Co Inc property on both sides of
Eckert Road, west of Tellier Road, in the Town of Arcadia. The mine site is immediately
north of Class 1 Freshwater Wetland PA-29.
Operation of the mine will continue surface
extraction of sand and gravel. Excavation
will be by front end loaders, and will remove approximately 400,000 tons of sand and
gravel from the 8 acre expansion area. Material will be processed on site as permitted
previously. Truck traffic is estimated by the applicant to continue to average
approximately 10 round trips per hour. Final reclamation will maintain the two ponds
currently on the site, with stockpiled topsoil replaced and re-seeding on the remainder of
the site to create re-vegetated open land. Hours of operation will remain weekdays from
6 AM until 6 PM, and Saturdays from 6 AM to noon, with no operations on Sundays.
The application is available for review
at the Region 8 NYSDEC office, and a copy of the
application materials has been sent to the Town of Arcadia.
