The project involves the
installation of erosion protection measures in approximately
3,000 linear feet of the Genesee River to protect the Belvidere Villa Homestead, a
registered historic site. The project includes the realignment of approximately 1,000
linear feet of the river low-flow channel, to about 300 feet to the south of an eroding high
bank with construction of a bench along the high bank; installation of 1325 feet of rock
riprap along the north bank, including the toe of the bench and the mouth of a small
tributary; the installation of three rock grad stabilizers in the river and one in the tributary;
the installation of four bendway weirs and the installation of anchored tree revetments. A
culverted driveway will also be constructed across the confluence of an oxbow (bayou)
with the river to facilitate construction and future maintenance. The project site is
upstream (south) of Allegany Couny Route 20, Gibson Hill Road.

Creation of the new Chautauqua
Heights Water District and acquisition of the
existing water supply facilities and distribution system from the Chautauqua Lake
Estates, to serve residents of Chautauqua Lake Estates, Point Chautauqua, Snider
Trust, and the Villas at Chautauqua Point and also Camelot Golf Course. The
Chautauqua Heights Water District will serve a total of 237 existing and 17 planned
units, most of which are seasonal condominiums and townhouses. Average
summertime daily demand is estimated at 36,200 gallons per day with a peak daily
demand of 96,300 gallons per day. System improvements are limited to upgrading
the water treatment plant, which withdraws water from Chautauqua Lake.

The
applicant proposes an existing discharge of 60,000 gallons per day of treated
(activated sludge secondary clarifier, tertiary sand filter and chlorination system) sanitary
wastewater and water treatment plant backwash to Chautauqua Lake from the
Chautauqua Heights Wastewater Treatment Plant. The wastewater treatment plant was
recently acquired from Chautauqua Lake Estates and will serve the newly created
Chautauqua Heights Sewer District.
The
Department has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System Permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. This tentative determination does not signify Department
approval for or endorsement of the activity for which a permit is sought or for the overall

The Department has drafted
and made a tentative determination to issue a modified
SPDES Permit No. NY-0000906 for an existing discharge of stormwater runoff from
eight outfalls into the Niagara River via Pikes Creek and City of Niagara Falls storm
sewers. The draft permit modification regulates several new outfalls. Outfalls 003, 005,
007, 008, and 009 have been added in response to the permittee's July 9, 1992 and
February 6, 1997 stormwater permit applications. All of the water quality based effluent
limits have been deleted from the draft permit modification. A short term monitoring
program required in the draft permit modification will provide a basis for determining
whether additional permit limits are needed. The permittee's plant is located at 5700
Niagara Falls Boulevard.
