Project Description: NYS Correctional Services, Hudson Correctional Facility has applied to the department for a Air State Facility Permit. The permit application includes proposed conditions for three existing boilers and one diesel powered electric generator. The Department has prepared a Draft Permit and has made a tentative determination to approve this application to permit emergency power generation units located at this facility so the permittee can participate in the Coordinated Demand Reduction Program (CDRP) and provide power to the electrical grid system to meet power shortages during periods of peak demand.  The Hudson Correctional Facility fires natural gas and distillate oil in it’s boilers and distillate oil in it’s generator.  The facility will be capping  NOx and SO2 emissions with a 78 ton per year limit for each of these contaminates thereby avoiding the thresholds for both the Title V and New Source Review Programs.  Project Location:  The existing facility is located in the Town of Hudson, Columbia County New York 125340576.  Public Notice: The New York State Department of Environmental Conservation (NYSDEC) hereby notices a complete application and proposed Air State Facility permit conditions for the Hudson Correctional Facility.  Document Availability/Public Comments: A copy of the draft permit can be obtained from the NYS Department of Environmental Conservation offices, Region 4 Headquarters at 1150 North Westcott Road, Schenectady, NY 12306, between 9:00 AM and 4:00 PM, Monday through Friday or by calling Nancy Adams, Project Manager at (518) 3572452. Comments will be received for 30 days from the date of this notice.  If comments are received which raise significant issues or provide additional relevant information, the Department may modify the draft Air State Facility Permit.

The applicant proposes to construct a driveway for a single family home through the adjacent area of Freshwater Wetland CL-18.  The driveway will be approximately 90' from the wetland boundary encroaching into the 100' adjacent area by only 10'.  The site is located on the north side of Cedar Hill Road in the Town of Clermont, Columbia County.   

The applicant proposes a new discharge averaging 250 gpd of treated wastewater from an oil/water separator to a tributary of Murderer's Creek and discharge of treated sanitarty wastewater to groundwater from the proposed Greene County Highway Garage, to be located on NYS Route 9W, 3/4 mile north of Schoharie Turnpike, in the Town of Athens, Greene County.  The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law.  This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time.  As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.  As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.  A draft permit is available for inspection and comment at the Region 4 Office noted below.  SPDES #NY-0268429

The applicant proposes to place heavy stone rip rap along approximately 150 feet of eroded streambank along Wharton Creek to control erosion to agricultural fields.  The project is located on Munson Road just south of the intersection with County Route 22.
