Negative Declaration

Erie County – The Erie County DEP, as lead agency, has determined that the proposed Erie County Sewer District No. 2, Herr Road, Buffalo Beach and Shore Cliff Pumping Stations Modifications (SRF No. 6646–09–00) will not have a significant adverse environmental impact. The action involves replacement of approximately 3,000 linear feet of 8 in. sanitary sewer force main in existing permanent rights–of–way/easements; and, rehabilitation of 3 pump stations. The project is located at Shore Cliff Pump Station (No.7), Herr Road Pump Station (No.8), Buffalo Beach Pump Station (No.4) Lake Shore Road, Town of Evans.

Erie County – The Town of Amherst Planning Board, as lead agency, has determined that the proposed Site Plan Review – University Village at Sweet Home Student Housing will not have a significant adverse environmental impact. The action involves the construction of 272 units of student housing in nine (9) buildings (one 3–story building and eight 4–story buildings), a 785 space parking lot and a 16,000 sq. ft. community center at 1772 Sweet Home Road. The property is located on the west side of Sweet Home Road, approximately 600 feet south of Skinnersville Road, and opposite Sweet Home High School. The property is currently vacant with some wooded areas on the north side. The rezoning of 19.52 acres of land at the subject location from Shopping Center (SC) to Multi–Family Residential District – Six (MFR–6) (Z–8–04) was granted by the Amherst Town Board on May 17, 2004. The petitioner is American Campus Communities, LLC, 805 Las Cimas Parkway, Suite 400, Austin, Texas 78746. The project is located at 1772 Sweet Home Road, Amherst.

Erie County – The Town of Amherst Town Board, as lead agency, has determined that the proposed Transfer of Town Property to North Amherst Fire Company will not have a significant adverse environmental impact. The action involves an 8.0 acre parcel located at the northeast corner of the intersection of Tonawanda Creek Road and Campbell Boulevard, adjacent to the North Amherst Fire Company station. The parcel is presently open space. The Fire Company‘s intent is to use this property for expansion of the fire hall, access to the Erie Canal for emergency purposes, recreation and open space preservation.

Erie County – The Town of Amherst Planning Board, as lead agency, has determined that the proposed Site Plan Review for Proposed Crosspoint Business Park – Geico Office Building will not have a significant adverse environmental impact. The Geico office building is proposed to be located at 300 Crosspoint Parkway in the existing Crosspoint Business Park. The 21.36 acre property is located at the northwest corner of Crosspoint Parkway, 2,400 feet north of North French Road. The property abuts the I–990 and the Niagara Mohawk right–of–way, and contains a portion of a NYSDEC freshwater wetland and possible federal wetlands. The petitioner seeks to construct a 255,467 sq. ft. office building for Geico and 1,315 space parking lot. The project is located at 300 Crosspoint Parkway, Amherst, NY.

Notice Of Acceptance Of Draft EIS And Public Hearing

Niagara County – The Town of Lewiston, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Town of Lewiston Municipal Golf Course and Residential Subdivision. A public hearing on the Draft EIS will be held on July 26, 2004, at 6:00 p.m. at the Town of Lewiston Town Hall, Lewiston, NY. Written comments on the Draft EIS will be accepted until August 9, 2004. The action involves construction and operation of the following facilities on approximately 250–acres located within the Town of Lewiston:

The project area is bounded by Pletcher Road to the north, Creek Road to the east, Robert Moses Parkway to the west, and the Lewistowne Park Subdivision to the south in the Town of Lewiston, Niagara County, New York.
