|
The applicant proposes a wetland
restoration and enhancement project to improve
wildlife habitat within a 547 acre United States Department of Agriculture, Natural
Resources Conservation Service, Wetland Reserve Program (WRP) easement site. The
proposal includes constructing five wetland potholes 0.84 to 3.44 acres in size totaling
approximately 9.75 acres and planting the excavated areas with a variety of wetland
plants to promote species diversity, waterfowl foraging habitat, research and education.
Excavated spoil will be used to repair existing trails at the facility. The proposal is
located in the Zaepful Nature Sanctuary, east of Windmill Road, west of Farm Market
Road and north of Rt. 242, in the regulated 100-foot wide Adjacent Area of Freshwater
Wetland RA-2.

The application reflects
a change of ownership of the campground and an existing
discharge of 16,400 gallons per day of untreated sanitary wastewater through a septic tank
and absorption bed to groundwater. The facility is Jellystone Park of Western New York,
located on Youngers Road in the Town of Java, Wyoming County. The Department has
made a tentative determination to issue a permit for a State Pollutant Discharge
Elimination System Permit under Article 17 of the Environmental Conservation Law.
This tentative determination indicates that the discharge regulated under this statute is
considered to satisfy regulatory standards for permit issuance, based on information
available to the Department at this time. As a tentative determination, the Department
seeks comments on the proposed regulated activity prior to making a final decision on
permit issuance. As such, this tentative determination does not signify Department
approval for or endorsement of the activity for which a permit is sought or for the overall
