Notice Of Public Hearing


NOTICE IS HEREBY GIVEN, pursuant to §806(3) of the Adirondack Park Agency Act (Executive Law, Article 27) and Part 572 of the regulations of the Adirondack Park Agency, that the Agency will hold a public hearing on an application of the Town of Elizabethtown for a variance of the statutory shoreline setback restriction.

The public hearing will be held on June 29, 2004, beginning at 10 am, in the Town of Elizabethtown town offices at 7563 Court Street, Elizabethtown.

The Town has asked the Agency to grant a variance from the 100–foot shoreline setback applicable to structures on land classified Rural Use in order to construct a 3–foot wide, 300–foot long boardwalk along the northern shore of Deep Hollow Pond on property owned by the Town. This property, identified as Tax Map Parcel 55.000–1–23, is situated on NYS Route 9 (adjacent to the Cobble Hill golf course). The boardwalk is intended to provide public fishing access to the pond, while allowing erosion control measures to be undertaken and maintained on the banks of the pond.

The variance application is available for public inspection and copying at Agency headquarters on Route 86, Ray Brook, New York, on weekdays between 8:30 am and 5:00 pm and also at the Town offices during regular business hours. Pursuant to §572.15 of the Agency’s regulations, a copy of this notice is being mailed to all landowners within 500 feet of the project site based on the latest tax assessment list.

An appointed Hearing Officer has authority to adopt procedures deemed necessary and appropriate for the orderly conduct of the hearing, including formal taking of testimony, cross–examination of witnesses and reasonable limitations on testimony. Persons and public entities entitled to individual notice by law and others, at the discretion of the Agency or the hearing officer, may participate in the hearing. Persons wishing to submit written comments on the variance application are encouraged to do so, whether or not they attend the hearing, by mailing them to Mark E. Interpreter services will be made available at the hearing to deaf persons at no charge, upon advance request to the Agency.

Project Title: Warren County/Starbuckville and Chester Creek Bridges

Location: County Road 53 in the Towns of Chester and Horicon

Project Description: The action involves replacement and realignment of the one lane (14 feet wide) Starbuckville Bridge over the Schroon River with a two lane (33 feet wide) bridge, replacement of the two lane (26 feet wide) Valentine Pond Road Bridge over Chester Creek and improvements to the roadway between the two bridges and roadway approach leading to Starbuckville Bridge on the north side. Unavoidable impacts to the existing wetlands will involve a loss of 0.029 acre of wetland area. Proposed wetland mitigation will involve the creation of 0.027 acre of wetland. The project is located within the “river area“ of the Schroon River, a designated recreational river in the New York State Wild, Scenic and Recreational Rivers System.

Project Title: : North Country Helicopter Services, L.L.C.

Location: Adirondack Regional Airport in the Town of Harrietstown.

Project Description: : The action involves new commercial uses in an existing 4,800 square foot aircraft hangar consisting of helicopter charter and scenic tour business; storage of aircraft, aircraft parts and marine equipment; and a helicopter flight school. No on–site mechanical and other repairs, maintenance activities or storage or use of fluids and chemicals will occur as part of this project. The project will operate annually from late Spring into the Fall months, seven days per week, during daylight hours. Up to 15 customers/visitors are anticipated on a daily basis. On–site wastewater treatment and water supply facilities are to be used.

Project Description: Five–lot subdivision, including: after–the–fact review of Tax Lot Nos. 19, 20.11 and 20.12 {lots 19 and 20.11 each count as two lots for the purposes of Agency jurisdiction, due to division by the public road}; and review of the currently proposed two–lot subdivision of tax lot 20.13, creating a new 15 acre lot and a new 40 acre lot which will be conveyed to an adjoining landowner and merged with adjoining property. Three of these lots have existing single family dwellings and no new land use or development is currently proposed. Site is accessed by Walker Road.

Negative Declaration

Franklin County – The Town of Altamont/Village of Tupper Lake Planning Board (a Joint Planning Board), as lead agencies, have determined that the proposed Tillack Special Review Use Permit Amendment will not have a significant adverse environmental impact. The action involves a request for a Special–Review Use Permit Amendment to allow construction of one additional commercial mini storage building, measuring 40 feet wide by 22 feet deep, off the south side of Santa Clara Avenue, and west (on the Demars Boulevard side) of the two existing 40 foot by 100 foot commercial mini storage buildings. The new commercial mini storage building will contain four units measuring 10 feet wide by 22 feet deep. The four new units will be accessed from doorways facing Santa Clara Avenue. The new building will have fiberglass shingles and wood siding. The siding will be the same color as that of the existing storage buildings immediately to the east. This subject action represents a Special Review Use in the Village’s Commercial Zoning District. The project is located on Santa Clara Avenue (Village Tax Map Section 490.35–Block 2–Lot 4 and consisting of approximately 5.41 acres); in the Village of Tupper Lake (Town of Altamont, Franklin County, NY 12986).

A public hearing on the Draft UMP/EIS will be held on June 30th, 2004 at 6:00 p.m. at the Newcomb Fire Hall located on Route 28N in Newcomb.
