The addition of 51.76 acres
to the existing, currently permitted 115.1 acre Lippert Gravel
Pit is proposed. Of the proposed expanson acreage, 19.35 acres is located north of South
Nine Mile Road (Montanye Property), east of and contiguous with the previously mined
area. The remaining 32.41 acres is located south of South Nine Mile Road, east of and
contiguous with the previously mined area and the mine plant and office area. Excavation
below the ground water table is proposed, which will increase the size of the existing
17.86 acre mine lake north of south Nime Mile Road to 28.68 acres and the size of the
existing 19.8 acre mine lake south of South Nine Mile Road to 51.2 acres. Lake shores
and surrounding disturbed area will be graded to stable slopes and vegetated with
perennial grasses and legumes. The estimated life of the expansion is 10 years.

The Department has drafted
a modified permit and intends to modify SPDES Permit No.
NY-0204862 for the addition of a bus garage wastewater collection and treatment
(oil/water separator) system at the Cattaraugus-Little Valley High School/Elemetary
School located in the northeast corner of the Village of Cattaraugus. The school campus
is bounded by Carter, Jefferson and North Franklin Streets. In addition to an existing
discharge of 14,400 gallons per day of treated sanitary wastewater from a septic
tank/leach field system into groundwater, an estimated average flow of less than 100
gallons per day of treated bus wash water is proposed to be discharged from an oil/water
separator to Tributary 7 of the South Branch of Cattaraugus Creek. The Cattaraugus
campus serves a population of approximately 1,115 students and faculty.

The Grandview Bay Beach
Owners Association, Inc., comprised of local residents,
proposes to perform periodic dredging of the mouth of Delaware Creek at Lake Erie.
Dredging will be performed up to 6 times per year, between May 1 and September 15 of
each year, to eliminate water stagnation by maintaining stream flow and prevent flooding
and erosion of resident beach properties. The Homeowners Association, with Town of
Evans' concurrence, will attempt to maintain the mouth of Delaware Creek within the
property lines of Purvis Landing, which is owned by the Town. Application materials are
available for review and comment at the Region 9, Buffalo Office.
