The Department has made a tentative decision to approve a renewal for a Title IV Acid Rain Permit as required by 40 CFR Part 72 due to emissions of Sulfur Dioxide caused by activities of generating electricity. The plant supplies electricity to Con Edison and the Brooklyn Navy Yard and supplies steam to Con Edison, the Brooklyn Navy Yard and the Red Hook Water Pollution Control Plant. In accordance with 6 NYCRR Parts 621 and 201, the Administrator of the USEPA has the authority to bar issuance of this permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

Applicant proposes to operate a temporary dewatering system to facilitate the construction of structures for Shaft 19B of City Tunnel #3 with a maximum withdrawal of 4,320,000 gallons per day.  Construction will take place at the job site located on Grand Avenue near Page Place in Queens, NY.  The pumped groundwater discharge is to be directed into a settling tank and then to a 54 inch storm sewer located on Grand Avenue that discharges into Newtown Creek at Grand Avenue.

The facility's emissions of nitrogen oxide are averaged with other facilities owned by NRG Energy Inc., according to a system-wide averaging plan approved by the Department, to verify compliance with the provisions of 6 NYCRR Subpart 227-2. In accordance with 6 NYCRR Parts 621 and 201, the Administrator of the USEPA has the authority to bar issuance of this permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.
