Bethpage
Energy Center 3, LLC., a subsidiary of Calpine Corporation, proposes to
construct and operate a combined cycle 79.9 MW electric generating station (the project)
adjacent to the existing TBG Cogen Partners cogeneration facility and CPN Bethpage 3rd
turbine, Inc. simple cycle gas turbine facility located at 939 South Broadway, Hicksville.
This project is an expansion of the existing power generation facility which consists of a
cogeneration plant and a simple cycle power plant.
The
project entails the construction and operation of a combined cycle power plant.
The new equipment includes a General Electric (GE) LM 6000 PC SPRINT Combustion
Turbine Generator (CTG), a two-cell wet cooling tower with a drift eliminator to serve
the inlet air chillers, a Once Through Steam Generator (OTSG) with duct burners, a steam
turbine generator (STG), a five-cell wet cooling tower with a drift eliminator, and
associated balance-of-plant systems and facilities.
This
project will be fueled exclusively by natural gas, and emissions from the CTG and
duct burners will exhaust through a single 100-foot stack. The projects’s peak water
supply requirements will be approximately 700,000 gallons per day and will be provided
by the Northrop Grumman Corp (NGC) which currently supplies the existing facility.
The
Applicant has filed individual applications seeking the issuance of (a) a
preconstruction state facility air pollution control permit pursuant to pursuant to Article
19 of the Environmental Conservation Law ("ECL") and Part 201 of Title 6 of the New
York Compilation of Codes, Rules and Regulations ("6NYCRR"), and (b) a Phase II acid
rain permit pursuant 40 CFR Part 72 as incorporated by reference at 6 NYCRR §200.10.
The DEC has tentatively determined that the applications meet all air pollution control
requirements of ECL Article 19, 6NYCRR Part 201, Part 204, Subpart 231-2, Part 227,
and Title IV (Acid Rain) of the Clean Air Act Amendments of 1990. The applicant is
also required to obtain emission reduction credits (ERCs) for NOx.
The
Department has made a tentative decision to approve the air permit applications,

The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for renewal of the Title V Facility Permit for Keyspan Wading
River Facility.
The Facility consists of
three combustion Turbines rated at 96.3 MW each. Oxides of
Nitrogen, NOx, Continuous Emission Monitors and inlet fogging have been installed at
these units. In addition, one 22MW and one 62MW Combustion Turbine operate at the
site. Two new regulations have been incorporated inthis renewal: Part 204 and Part
237.
In accordance with 6NYCRR
Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with
applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative listed below. It is recommended that an appointment be
made to confirm the availability of the subject files. The DEC will endeavor to make the
files available within 2 business days of contact, during normal business hours (8:30 am
through 4:45 pm), unless the requestor wishes to inspect the files at a later date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for
public comment. DEC's determination to hold a legislative public hearing will be based
on whether a significant degree of public interest exists. If a legislative public hearing
is
to be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative public hearing should be in writing and addressed to the
Department representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to

Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation law. for a proposed facility to discharge 42,000 gallons per day of
Laundromat process wastewater into groundwater from two outfalls. The facility,
Centereach Laundromat, is located at 2594 Middle Country Road, Centereach, Town of
Brookhaven, Suffolk County SPDES #NY 026 6744. The proposed discharge is located
within an area designated as a sole source aquifer. The following water purveyor has
been identified as having service areas located within a 3 mile radius of the applicants
facility: Suffolk County Water Authority, St. James Water District, Smithtown Water
District. This tentative determination indicates that the discharge regulated under this
statute is considered to satisfy regulator standards for permit issuance based on
information available to the Department at this time. As a tentative determination, The
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
