Notice of Emergency Adoption and Proposed Rule Making for 6NYCRR Section 41.3 relating to the sanitary condition of shellfish lands. This notice will be published in issue 22 of the State Register, dated 6/2/2004 and was effective upon filing on 5/13/2004.

Orange County - The Town of Monroe Planning Board, as lead agency, has determined that the proposed Harriman Business Park Lot 4 Commercial subdivision and site plan may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a request for site plan approval and commercial subdivision approval for the retail development of a property known as lot 4 of the Harriman Business Park. The applicant proposes retail commercial construction totaling approximately 300,717 square feet, down from the previously proposed 325,000 + square foot retail development; along with accessory circulation, loading and parking areas.

Orange County - The Town of Blooming Grove, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Lake Blooming Grove, LLC. A public hearing on the Draft EIS will be held on Wednesday, June 23, 2004, at 8:00 P.M. at the Town of Blooming Grove Town Hall, Horton Road and Route 94, Blooming Grove, NY. Written comments on the Draft EIS will be accepted until July 15, 2004. The action involves the applicant, Lake Blooming Grove, seeking approval for a thirty eight (38) lot subdivision of a 79.3 acre tract, located in the residential R-45 zone, having frontage along Lake Road, located in the Town of Blooming Grove. The property is currently vacant but was formerly used agriculturally. The proposed lots are to be served by individual subsurface sanitary disposal systems and individual wells. The 79.3 acre property comprises one tax lot: Town of Blooming Grove Tax Map I.D. Section 3, Block 1, Lot 59.21. The project site is located on the west side of Lake Road, in the Town of Blooming Grove, Orange County, New York.

Sullivan County - The Town of Thompson Planning Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Mohawk Mountain Resort and Casino Project. A public hearing on the Draft EIS will be held on June 23, 2004, from 7 p.m. to 9 p.m., or until the last public comment is received, at the Sullivan County Government Center, Legislative Meeting Room, 100 North Street, Monticello, New York. The action involves the St. Regis Mohawk Tribe (Tribe), through a development agreement with Ceasers Entertainment, Inc. f/k/a/ Park Place Entertainment Corporation, proposes to build a resort and casino complex to be called the Mohawk Mountain Resort and Casino (Project). The Project design contemplates a 750 room hotel and 165,000 sq. ft. casino and support area, a 2,500 seat theater and several restaurants spread across 66 acres, with a 5,200 stall parking garage on an adjacent, 108 acre parcel. On October 1, 2001, the Town of Thompson Planning Board received applications for site plan review, subdivision approval, demolition and other permits related to the project, which it is currently considering. The project is located along the east side of Anawana Lake Road (C.R. 103) in the Town of Thompson, Sullivan County, New York, approximately 3 miles north of the Village of Monticello.

Orange County - The Planning Board of the Town of Montgomery, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Village at Goodwill. The action involves the proposed Planned Adult Community which will consist of 500 units to be constructed on a 191.6 acre site. The project is located on Goodwill Road opposite Neelytown Road and west of Route 208, adjacent to the Village of Montgomery in the Town of Montgomery.
