The applicant proposes to
discharge 1,000 gallons per day of untreated process and
sanitary wastewater to groundwater from a proposed facility to be located on New York
State Route 19, approximately 1500 feet south of the Town Line Road in the Town of
Belfast. The applicant proposes to operate a laundromat. The Department has made a
tentative determination to issue a permit for a State Pollutant Discharge Elimination
System permit under Article 17 of the Environmental Conservation Law. This tentative
determination indicates that the discharge regulated under this statute is considered to
satisfy regulatory standards for permit issuance, based on information available to the
Department at this time. The Department seeks comments on the proposed regulated
activity prior to making a final decision on permit issuance. As such, this tentative
determination does not signify Department approval for or endorsement of the activity for
which a permit is sought or for the overall proposed project. In commenting, please refer

The applicant proposes to
control vegetation by the use of herbicides along various State
Routes in Allegany County. Parts of the roadside areas are within the regulated 100-foot
wide adjacent areas of several state freshwater wetlands. This vegetation management is
proposed near road safety-related appurtenances, such as road signs, delineators and
guiderails that are located along tops of embankments and are beyond the control and
personnel safety capability of mowing machines. The application of herbicides will
be
conducted by New York State Department of Transportation employees that haven been
certified as pesticide applicators by NYSDEC.

The Department has prepared
a SPDES draft permit modification (NY 0000973), which
would provide twenty (20) stormwater outfalls from the West Valley Demonstration
Project at 10282 Rock Springs Road. A similar draft permit has been prepared for
issuance to New York State Energy Research and Development Authority for stormwater
discharges (please see the other concurrently running public notice). The US Department
of Energy and the New York State Energy Research and Development Authority have
requested that separate permits be issued to each agency for stormwater discharges. This
draft permit modification also removes outfall 01A, which was never constructed, from
the existing permit. In addition, some sampling/monitoring requirements for the process
waste water outfall have been changed in the draft permit modification based upon the
collection and analysis of data at the facility that was required in the existing permit. The
stormwater outfalls discharge to: tributary (unnamed) of Erdman Brook, Class D, and
Erdman Brook, Class D; tributary (unnnamed) to Franks Creek, Class C and wetland to
Franks Creek, Class C; wetland tributary to Quarry Creek, Class C; and tributary
(unnamed) to Buttermilk Creek. The draft permit requires a twice yearly sampling of
stormwater runoff from certain specified rainfall events. The permit also contains a
schedule that requires the permittee to prepare and submit a Stormwater Pollution
Prevention Plan. The draft permit, fact sheets and materials submitted in support of the
application are available for review and comment in both the regional office listed in this
notice and the Albany office at 625 Broadway.

The Department has prepared
a draft permit (NY 0269271), which regulates the discharge
of stormwater from the NYS Licensed Disposal Area at 10282 Rock Springs Road. The
permit would be issued to New York State Energy Research and Development Authority.
A draft permit modification, adding stormwater outfalls, has also been prepared for the
adjacent US Department of Energy - West Valley Demonstration Project (please see the
other concurrently running public notice). The New York State Energy Research and
Development Authority and the US Department of Energy have requested that separate
permits be issued to each agency for control of stormwater. Six outfalls, for stormwater
are included in this draft permit, which discharge to the listed water courses: WO1,
tributary (unnamed) to Erdman Brook, Class D; WO2, Erdman Brook, Class D; WO3 and
WO4, tributary (unnamed) to Franks Creek, Class C; WO5, wetland tributary to Franks
Creek, Class C; and WO6, tributary (unnamed) to Erdman Brook, Class D. The draft
permit requires a twice yearly sampling of stormwater runoff from certain specified
rainfall events. Sampling/monitoring requirements in the draft permit are based on review
of the data provided in the SPDES application. The permit also contains a schedule that
requires the permittee to prepare and submit a Stormwater Pollution Prevention Plan. The
