Region 9 , Cattaraugus County, Persia (T) - Gowanda Day Habilitation Center, 4 Industrial Place, Gowanda, New York 14070

New York State Office of Mental Retardation and Developmental Disabilities (OMRDD). has submitted a work plan to the Department, to implement an Interim Remedial Measure (IRM) intended to substantially remediate the property locally known as the Gowanda Day Habilitation Center in the Town of Persia. The majority of the area to be remediated is overlain by a cement block structure housing the former Gowanda Day Habilitation Center. The work plan has been submitted to remediate the property to support industrial/commercial land use.

From 1945 until 1979 previous owners used site facilities for stamping, machining and warehousing. OMRDD occupied the building for offices from 1982 until 1992, acquiring the property in 1989. OMRDD used the facility as a day habilitation center where primary activities included crafts, recreation and living skills training.

Soils requiring remediation have been characterized as containing constituents of cleaning products consisting of volatile organic chemicals, such as, cis1,2-dichloroethene and trichloroethene. The localized groundwater is contaminated with the same volatile organic chemicals found in the soil. The work plan details construction necessary to implement a dual phase system consisting of groundwater pumping and treatment, and soil vapor extraction and treatment system. Contemplated future use of the facility is consistent with local zoning ordinances.

Comment Period: The work plan is available for public review at the location noted below. Written comments will be accepted for 30 days following the date of this notice. Written comments expressing objection or opposition to the work plan must explain the basis of that opposition and identify the specific grounds that could lead the Department to impose significant changes to the IRM work plan. No formal response to comments received is anticipated, but, because of the comments, the Department could re-evaluate and revise the IRM work plan.

Cattaraugus County - The Village of Ellicottville Board of Trustees, as lead agency, has determined that the proposed Adoption of the Village of Ellicottville Comprehensive Plan will not have a significant adverse environmental impact. The action involves adoption of the Village of Ellicottville Comprehensive Plan, which documents: Purpose, Existing Conditions, Development Trends, Economic Activity, and Community Facilities. The Plan also states Goals and Objectives for the Village, and provides Recommendations and an Action Plan for guiding future growth within the Village.

Erie County - The Town Of Amherst Planning Board, as lead agency, has determined that the proposed Site Plan Approval for Office Park Expansion will not have a significant adverse environmental impact. The action involves a proposed Park Club Lane Office Park Expansion to be located at 190 & 199 Park Club Lane. The petitioner is Ciminelli Development Co., Inc., 350 Essjay Road, Williamsville, NY 14221.

The property is located on the north and south sides of Park Club Lane, 1,300 feet north of its intersection with Main Street, and adjacent to the Youngmann Expressway (I-290) on the south and the Niagara Mohawk Power Corp. right-of-way on the north. The south portion of the parcel, to be developed as #190 Park Club Lane, is presently vacant and partially wooded; a 1-story 18,000 sq. ft. office building is proposed for this area. The north portion of the parcel, to be developed as #199 Park Club Lane, presently contains the 2-story brick former Bishop Neumann rectory building and parking lot that will be demolished to accommodate a proposed new 1-story 70,000 sq. ft. office building and parking. The remainder of the north portion is vacant and wooded. This property lies within close proximity to State-designated wetland BN-1.

Erie County - The Town of Amherst Planning Board, as lead agency, has determined that the proposed Rezoning 2211 Sweet Home Road will not have a significant adverse environmental impact. The action involves the rezoning of 1.11 acres of land from New Community District Major Open Space (NCD-MOS) to New Community District Neighborhood District (NCD-ND) located at 2211 Sweet Home Road in the Town of Amherst (Z-17-03). The petitioner is Bevilacqua Associates Development, Inc., 193 Halston Parkway, East Amherst, NY 14051.

The property is located at the southeast corner of Sweet Home Road and Pasagrille Drive, approximately 150 feet south of Ellicott Creek. The property is currently vacant and wooded. The petitioner proposes to develop 12 two-story apartment units and a 24-space parking lot. One driveway entrance is proposed on Sweet Home Road. The Ellicott Creek floodway is located in the northeast corner of the property.

Positive Declaration

Cattaraugus County - The Planning Board of the City of Olean, as lead agency, has determined that the proposed 174 North Union Street/Residential Apartments may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a conversion of an existing two-story commercial building into eight residential apartments (including residential units on the first floor). The proposed project is located in the City Center district and does not comply with the City Center Zoning district requirements which prohibit residential uses on the first floor of buildings. In addition, the proposed first floor residential apartments are contrary to the goals and objectives of the Downtown Strategic Plan and the Draft Comprehensive Development Plan. The project is located at 174 North Union Street, City of Olean.
