Pursuant to the Environmental Conservation Law, Sections 13-0340-b, 13-0340-e and 13-0340-f, the Department of Environmental Conservation hereby gives notice of the following:

Notice of Emergency Adoption and Proposed Rule Making of 6NYCRR Part 40 relating to marine fish. This notice will be published in issue 19 of the State Register, dated 5/12/2004 and was effective upon filing on 4/23/2004.

Public Notice

Cutting of Trees in the Forest Preserve

Ulster County - This action involves the cutting of trees at Belleayre Mountain Ski Area to improve public safety and recreational use of the downhill skiing facility. This is to provide notice that a total of 35 trees over 3" in diameter will be removed to accomplish the construction of a transfer line for the potable water system, as required by Commissioner’s delegation memorandum # 84-06. This project is included in the approved 1998 revision and July 2002 amendment to the Unit Management Plan for the ski center. There are no known rare, threatened or endangered plant species located in or bordering the disturbed area. Following tree cutting and stump removal, the transfer line will be seeded and mulched.

Brownfield Cleanup Program

The New York State Department of Environmental Conservation (Department) administers the Brownfield Cleanup Program pursuant to ECL 27-1400 et seq. The Brownfield Cleanup Program is designed to encourage the remediation of contaminated properties known as brownfields for reuse and redevelopment. Ms. Rose Pelino has submitted an application to participate in the Brownfield Cleanup Program. The application was determined to be complete by the Department on April 27, 2004. The property described in the application is located at 28 IBM Road, Poughkeepsie, New York 12601. The application proposes that the applicant will conduct investigation and/or remedial activities at the site. The application proposes that the site will be used for commercial purposes.

The Department will receive public comments concerning the application for thirty days from May 12, 2004 through June 11, 2004. A copy of the application is available by contacting the Department’s representative at the address listed below or in the document repository for this site located at the NYSDEC, Region 3 Office, 21 South Putt Corners Road, New Paltz, New York 12561.

The referenced documents are draft and have not been reviewed by the Department staff prior to their release for public comment. The Department, in conjunction with the New York State Department of Health, will review these documents during the public comment period.

Negative Declaration

Orange County - The Town Board of the Town of Newburgh, as lead agency, has determined that the proposed Improvements to Chadwick Lake Park Developed Area will not have a significant adverse environmental impact. The action involves the adoption of a “Master Plan” and the subsequent construction and development of general improvements in the municipal park known as Chadwick Lake Park. The project is located on Route 300 in the Town of Newburgh.

Putnam County - The Carmel Central School District, as lead agency, has determined that the proposed Carmel High School Expansion and Renovation will not have a significant adverse environmental impact. The action involves a building expansion and renovation to convert existing classrooms to new functionality, construct a two-story classroom addition to provide new instructional space, and provide a staircase/elevator corridor to connect new and existing wings. The project is located at 30 Fair Street, Carmel, NY.

Notice Of Acceptance Of Draft EIS And Public Hearings

Orange County - The Planning Board of the Town of Blooming Grove, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Lake Blooming Grove LLC. A public hearing on the Draft EIS will be held on June 23, 2004 at 8:00 p.m. at the Blooming Grove Town Hall, Horton Road and Route 94, Blooming Grove, NY. The action involves approval of a thirty-eight (38) lot subdivision of a 79.3 acre tract in the residential R-45 zone having frontage along Lake Road, located in the Town of Blooming Grove. The property is currently used agriculturally. The proposed lots are to be served by individual subsurface sanitary disposal systems and individual wells.

Notice of Acceptance Of Final EIS

Orange County - The Planning Board of the Town of Montgomery, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Overnite Transportation Company Terminal. The action involves construction of a 93,500 sq. ft truck terminal on a 30.5 acre site on Route 99 adjacent to the Home Depot Warehouse Distribution Center and across from the Do-It-Best Distribution Center. The building contains a 7,000 sq. ft. office and will be constructed in two phases as business warrants. An 11,000 sq. ft. truck service facility will be built on-site in the parking area. Automobile parking is provided for 237 vehicles and there are 166 truck loading docks and spaces plus parking for an additional 333 truck trailers.

Orange County Board of Trustees of the Village of Kiryas Joel, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Catskill Aqueduct Connection. The action involves construction of a tap of the Catskill Aqueduct and a transmission main to transport water supplies to the Village of Kiryas Joel. The project will include a water treatment plant and pumping station. The water supply pipeline will extend from the NYC Catskill Aqueduct connection in New Windsor, NY along Riley Rd, State Rt.94, Clove Rd., County Rt. 27, State Rt 208, and State Rt. 17 to its termination in the Village of Kiryas Joel, Orange County, NY.

Ulster County - The Town Of Woodstock Planning Board, as lead agency, has accepted a final Environmental Impact Statement on the proposed Karma Triyana Dharmachakra (KTD) Monastery Replacement Residence, Site Plan (SPR #00-293) and Special Permit (SUP #00-290). The action involves the Karma Triyana Dharmachakra (KTD) an existing Tibetan Buddhist "church or other place of worship" consisting of a Monastery, Shrine and related outbuildings and site improvements. The proposed action includes, but is not limited to, the demolition and replacement of the current residential/office building (existing monastery) with a "U-shaped" approximately 43,000 square foot replacement monastery (consisting of residential and office space) forming an exterior courtyard also utilized for religious purposes, along with related site improvements (parking, landscaping, utilities, etc.). The proposed action is located within an R5 Residential Zoning District and Scenic Overlay District in the Town of Woodstock. The project consists of approximately 23 acres located at 352 MacDaniel Road, designated on the Town of Woodstock Tax Maps as Section 16.000, Block 2, Lot 16, in the Town of Woodstock, Ulster County, New York.
