Title: NYS Department of Environmental Conservation, Division of Environmental Remediation, Brownfield Cleanup Program Guidance: Draft May 2004

Subject: Draft Program Policy

Description: The main purpose of this guidance document is to provide interested parties with guidance relative to the undertaking of a project in the newly established Brownfield Cleanup Program (BCP). New York State established the BCP to address the environmental, legal, and financial barriers that often hinder the redevelopment and reuse of contaminated properties. The BCP is set forth in Title 14 of Article 27 of the New York State Environmental Conservation Law.

This document provides guidance to a party applying to the BCP and will guide the successful Applicant through the administrative steps necessary to investigate, select a remedy and implement that remedy. The guidance also provides an Applicant with the citizen participation requirements of the BCP, and insight into the process for administering and approving the various submittals required to successfully complete the project and receive a certificate of completion. The goal under the BCP is to remediate the site to a level that is protective of public health and the environment; taking into account the current, intended, and reasonably anticipated future use of the site. Administrative procedures and requirements specific to the BCP, that are not otherwise covered in the "DER Technical Guidance Document for Site Investigation and Remediation," are addressed in this guidance document. Comment Period: Comments on this action will be accepted for 60 days following publication in the ENB. The last day for receipt of comments will be 7/12/04. Comments should be sent to both individuals identified in this notice. Any questions should also be directed to these individuals. At the end of this comment period, all comments will be considered and the document will be revised accordingly. A final policy document will be prepared and notice will appear in the ENB.
