The applicant proposes to
construct a 109 unit (two-family) residential development.
Approximately 13 of the proposed units are located within the adjacent area of NYSDEC
regulated Class I Freshwater Wetland AR-1 (Staten Island Industrial Park). The project
site was subject of NYSDEC Freshwater Wetland Permit 20-87-0178 issued on
September 17, 1987 for construction of a 135 unit residential development including
pond creation and wetland restoration. The mitigation was accepted by NYSDEC on July
23, 1993. The current application proposes a 40 foot wide deed restricted planted buffer
area between the development and the wetlands. On July 31, 2003 a Phase I
Environmental Site Assessment was conducted at the project site to identify recognized
environmental conditions associated with current and historical property use. The site
assessment confirmed the presence of semivolatile organic compounds (SVOCs) and
metals above TAGM cleanup objectives in non-native materials in areas of the site where
solid waste was placed in October 1991 and February 1992. This area was the subject of
NYSDEC Order on Consent R23-4062-92-02. No SOVCs or metals were detected above
TAGM levels in samples collected from native soils beneath the solid waste. The current
permit application proposes covering the site with impermeable surfaces including
parking areas, building foundations and roadways. Areas remaining exposed after
construction will be capped by removal of surface materials and replacement with two
feet of clean fill to limit residential exposure. The project site is located on Lamberts
Lane between Graham Avenue and Elson Street, Staten Island, Block 1605 - Lot 1 and
Block 1600 - Lot 105.

The Department has made
a tentative determination to approve this application for a
modification of the existing SPDES permit for a discharge of treated wastewater into the
Arthur Kill (Class SD) from a chemical and physical treatment plant at the applicant’s
facility located at 310 West Service Road (NY 440) Staten Island, New York 10312,
where the plant treats leachate collected from Sections 1/9, 6/7, 2/8, and 3/4 of the
landfill. The modifications include the addition of new wastewater (from treatment of
gas condensate), the addition of new limitations for the following categorical parameters:
BOD, TSS, Alpha Terpineol, Benzoic Acid, p-Cresol, Phenols and Zinc, and the removal
(due to completion) of monitoring requirements for 40CFR 445 parameters and
stormwater management plan from the Schedule of Compliance. A draft permit is
available for inspection and comment at the regional office.
