In an ENB notice published on April 7, 2004, OFT declared its intent to hold public scoping hearings at sixteen (16) locations throughout the State of New York regarding the design, deployment and operation of the SWN described in that notice. The location of the public scoping hearing to be held in the Buffalo area has been updated as follows:

Negative Declaration

Niagara County - The Board of Trustees of the Village of Barker, as lead agency, has determined that the proposed Adoption of a Local Law Amending the Village Code of the Village of Barker will not have an adverse environmental impact. The project involves an amendment to the Village Code of the Village of Barker by adoption of a Local Law relating to F-1 Districts and Special Use Permits. The project is village wide.

Niagara County - The Porter Town Board, as lead agency, has determined that the proposed Town of Porter Comprehensive Plan may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves preparation and adoption of a new Town Comprehensive Plan to identify Goals, Policies and Actions that will guide future decision-making in Porter. The action involves the adoption of the Porter Comprehensive Plan by the Town Board pursuant to Town Law sections Section 272-a. The Comprehensive Plan includes the following information:

Notice Of Acceptance Of Final Supplemental EIS

Cattaraugus County - The New York State Department of Environmental Conservation, as lead agency, has accepted a Final Supplemental Environmental Impact on the proposed Gernatt Asphalt Products, Inc. - Bedrock Gravel Pit Modifications. The action involves:

Project Location: The existing mine is located west of Horton Road and east of Great Valley Creek and the proposed new plant site is located at the end of McDonald Road, west of Great Valley Creek and Southeast of NYS Route 219 and the Buffalo & Pittsburgh Railroad, in the Town of Great Valley, Cattaraugus County.
