Project Title: Harrison Red Oak Associates, L.P.

Project Description: The project is the subdivision of 460.50± acres into three lots. Lot A is a 119.56± acre parcel to be conveyed with the right to build a hunting and fishing cabin. Lot A will not have a principal building right associated with it. Lot B is a 55.94± acre lot to be conveyed to J. Carter Bacot. It will merge with other adjoining lands in his ownership. Lot B does not have a principal building right associated with it. The third lot is a 285± acre "Timber Lot" to be retained by the applicant with other adjoining lands. The 285± acre "Timber Lot" has an existing hunting and fishing cabin on it and includes an existing private access road to a previously authorized subdivision on the shoreline of Lake Champlain (APA Project 77-220 and Permit 77-282A). The "Timber Lot" also does not have any principal building rights associated with it but does adjoin other previously authorized lots owned by the applicant with building rights. No new land use or development is proposed for any of the lots as part of this project.

Project Title: Town of Waverly landfill closure

Location: Lake Ozonia Road

Project Description: The Town of Waverly is proposing to permanently close a Town landfill involving wetlands, a pond and a stream. Two beaver dams will be removed from an adjacent stream and the stream bed will be “channelized” and reconstructed which will result in lowering the elevation of water in an adjacent pond/wetland complex approximately four feet. Approximately 3,500 square feet of waste will be removed from wetlands and a driven sheet piling/earthen “cut-off wall” will be constructed along the edge of waste to isolate the landfill refuse and associated leachate from the adjoining site resources (ground and surface waters, wetlands, pond and stream). The purpose of lowering the water elevation and constructing the “cut-off wall” is to stop ongoing contamination resulting from groundwater permeating the existing landfill refuse and causing additional leachate generation and discharge to ground and surface waters. Additionally, the landfill will be graded, capped and vegetated to stop ongoing surface water penetration of the refuse which currently results in additional leachate generation and adverse ground and surface water, wetland and water quality impacts. As part of the landfill closure plan two, two-lot subdivisions involving wetlands will be undertaken. Two 3/4± acre lots which currently involve the landfill and are an integral part of the landfill closure plan will be subdivided from adjoining lands and conveyed to the Town. The Town of Waverly is subject to a New York State Department of Environmental Conservation Order on Consent pertaining to the construction and close-out of the landfill.
