Project Description:
The applicant proposes a temporary modification of the sequence of mining specified in the approved Mined Land-Use Plan for removing bank-run material from Mining Area #3, and to use as the haul road, a former farm road that accesses NYS Route 98.  Mine Area #3 is approximately 1,000 feet north of Route 98 and 1,800 feet west from Laidlaw Road (Cattaraugus County Route 80) and the haul road intersection is approximately 1,200 feet west of the Laidlaw Road/Route 98 intersection.
State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency:
None Designated
State Historic Preservation Act (SHPA) Determination:
A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than May 28 2004.

The applicant proposes to add 2.2 acres to and delete 0.6 acres from the existing 9 acre mine.  No changes in mine operating procedures and the reclamation objective (meadow and wildlife habitat) are proposed.  The mine site is located approximately 1,300 feet south of Falls Street and 3,300 feet east of New York State Route 240.  The new area is at the southwest corner of the existing mine.
