The City of Rochester proposes
to construct the Riverfront Development project along
the western shore of the Genesee River shoreline from Petten Street to Latta Road. The
project includes dredging approximately 1,600 cubic yards (CY) from the western
shoreline of the Genesee River, between the O'Rorke Bridge, along the train depot
building, and north to the Fast Ferry dock. The project also includes 1,150 linear feet
(LF) of rock riprap for bank stabilization, 450 LF of stacked stone under the O'Rorke
Bridge, a public boat launch with concrete ramp and parking south of the O'Rorke bridge,
concrete foundation and retaining wall to support the existing train depot (93 feet LF), a
transient boater facility to be constructed north of the train depot (167 CY of fill below
mean high), 240 LF of steel sheet pile and supported timber deck, 350 by 20 foot timber
deck, a 220 by 14 foot timber walkway, multiple docking facilities for day and long term
use, and a new fishing access point. The file is available for review and comment at the

Program.

Applicant proposes to construct
an 8,000 square foot restaurant with related parking,
lighting, landscaping and stormwater management facilities at 1384 Empire Blvd. on
Irondequoit Bay in the Town of Penfield, Monroe County. The site was previously
operated as a restaurant and marina facility. Marina will be operated under new owners
control but no additional dockage or marina improvements are proposed in this phase.
The stormwater management system includes a 50 ft. by 7 ft. rip-rap lined
spillway/outfall to Irondequoit Bay and installation of an engineered swirl concentrator
designed to provide primary treatment of collected stormwater. In addition minor parking
lot encroachment is proposed into an already developed portion of the 100 ft. adjacent
area of NYS Freshwater Wetland RE-1(I).

The Department has received an Air State
Facility application from Scepter Inc for the
expansion of its scrap aluminum processing operations at its Seneca Falls Facility,
located at 11 Lamb Road in the Village of Seneca Falls. Facility operations include
loading and melting of scrap aluminum and fluxing agents, casting of aluminum ingots,
and handling and disposal of the waste “salt cake”, which is the fluxing agent combined
with impurities. The expansion involves the addition of 2 new furnaces to the single
Facility Emission Unit, 1-FURNS.
Four furnaces were authorized in the original
Air State Facility Permit issued August 31,
1998, but two of the four were not built at the time of original construction. After
February 11, 1999, the addition of new furnaces became subject to the secondary
aluminum national emission standard for hazardous air pollutants (NESHAP)
requirements of 40 CFR 63 Subpart RRR. The present permit, issued prior to that date,
does not include 40 CFR 63 Subpart RRR requirements for the two furnaces to be
added, making modification of the permit necessary to allow Scepter to construct and
operate the third and fourth furnaces.
As part of this application Scepter has
proposed to limit the amount of scrap aluminum
processed to restrict facility emissions, and the Department has added Special Permit
Conditions to the Draft Permit, as follows:
Emissions of total particulates will continue
to be limited to less than the 6NYCRR Part
201-6 (Title V) threshold of 100 tons per year, as in the initial Air State Facility Permit.
Emissions of hydrogen chloride (HCl) in
the modified permit will be limited to less than
10 tons per year, to restrict facility hazardous air pollutant (HAP) emissions below the
Part 201-6 (Title V) threshold of 10 tons per year of any individual HAP compound, and
25 tons per year of all HAP combined.
Emissions of ammonia (NH3) from acid
gas control devices will be limited to 145 tons
per year in the modified permit to keep concentrations below the Department’s air
guideline concentration (AGC) for any off site receptor.
Emissions of hydrogen fluoride (HF) in
the modified permit will be limited to 0.265
pounds per hour (1.16 tons per year) to ensure compliance with HF standards in
6NYCRR Part 257-8.
In addition, Special Permit Conditions in
the modified permit will expand facility
monitoring to ensure compliance with Part 212.4c particulate, and Part 212.6a opacity
standards.
Finally, 40 CFR 63 Subpart RRR NESHAP requirements
in the modified permit include
stack testing for dioxins and furans for the two new furnaces. Dioxin and furan stack
testing showed emissions from the two existing furnaces in compliance with the
NESHAP standard.
To verify that the facility is in compliance
with Special Permit Conditions to restrict
emissions, Scepter will be required to maintain a monthly log of aluminum processed
and flux use at the entire facility, calculate monthly and 12 month rolling totals of
emissions, and report emissions to the Department annually. Emissions records are to
be maintained at the facility for a minimum of five years, and made available with all
supporting data to Department inspectors upon request.
