The Department has prepared a Draft Permit and has made a tentative determination to approve this application for the renewal of the existing Title V Permit for the applicant's printed plastic bag manufacturer.  The renewed permit does not change any allowable emissions or impose additional regulations.

In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.  It is recommended that an appointment be made to confirm the availability of the subject files.  The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.  DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.  A public hearing may be legislative or adjudicatory.  A legislative public hearing is a proceeding which provides an additional opportunity for public comment.  DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists.   If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments.   The applicant and all persons who  have filed comments on the permit will be notified by mail of the public hearing.  Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.  An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination.  An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist. The applicant proposes to increase the capacity of an existing irrigation well from 45 GPM to 50 GPM, for the purpose of lawn irrigation.  The well is 6" in diameter, approximately 319 feet in depth with a capacity of 50 gallons per minute.  The site is located at Mansion Drive, Old Westbury.

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and made a tentative determination to approve this application for the applicant's existing facility.  Air Techniques Inc. is a manufacturer of dental equipment. Metal and plastic parts are assembled and painted.  The facility is being limited to emit less than 22.5 tons per year of Volatile Organic Compounds (VOC's) and less than 22.5 tons per year of combined Hazardous Air Pollutants (HAP's)  With these limitations the facility will not be subject to the Title V requirements.  Record keeping and Reporting requirements are contained in the draft permit.  A copy of the draft permit is available at the Region I Stony Brook office.

The applicant proposes to remove and replace 116 linear feet of bulkhead in the same location, install 27 linear feet of bulkhead for boat slip, raise elevation of new bulkhead 18", construct two returns, dredge existing boat slip and two 5' x 25' areas seaward of the bulkhead to a maximum depth of 4 ft. below mean low water.  Resultant 18 cubic yards of dredged material and 120 cubic yards of trucked in fill to be used as backfill.  Install a 4 ft. wide capping boardwalk, a two pile elevator lift, and replace fence.  Property is located at 260 East Shore Drive, Massapequa, Town of Oyster Bay, County of Nassau on Canal #5 off South Oyster Bay.

The applicant proposes to remove and replace a set of three metal pipe drainage culverts and concrete headwalls within a NYSDEC regulated freshwater wetland (#BW-4).  The culverts will be removed and replaced one at a time, utilizing sand bags to temporarily divert water flow.  The project also includes removal of a drainage pipe leading from a catch basin on Byrd Street to the southernmost culvert.  A new pipe with leaching pool will be installed between the catch basin and the culvert, with an overflow outlet and pipe to the culvert.  The project is located at Lindenhurst High School, Charles Street, Lindenhurst, Town of Babylon, Suffolk County, SCTM # 0103-8-1-74.  

The Long Island Power Authority (LIPA) proposes to lease, install and operate twenty four trailer-mounted Cummins Power Generation Mobile Generation Units (MGUs) and ancillary equipment (fuel supply tanks, emission control equipment, transformers, etc.) on 3 acres of the 50 acre parcel owned by LIPA adjacent to the former Shoreham Nuclear plant. The MGUs will supply temporary power to the LIPA distribution grid to avoid voltage reductions and/or power blackouts.

Each of the MGUs has a rated maximum output of 1.825 megawatts (MW) of electricity, and the maximum electrical output of the facility consisting of the twenty four units together is 43.8 MW. The MGUs will be fueled by ultra low sulphur (0.003% or less) distillate oil, will have no water demand, and will generate no wastewater discharge.

The MGUs will supply temporary power to the LIPA distribution grid to avoid voltage reductions and/or power blackouts.

This property would be developed for a single family dwelling with an on-site waste water treatment system.  It is situated near the NYSDEC regulated freshwater wetland designated M-48 but lies outside the jurisdiction of the Tidal Wetlands Land Use Regulations due to the presence of a bulkhead measuring more than 100 feet in length which was in place prior to August 20, 1977.  Construction activities, including clearing and grading, would be conducted within 75 feet of the freshwater wetland boundary and the residence would lie partly within 90 feet of this boundary.

The applicant proposes to construct one 4" diameter well, approximately 26 feet deep, with a pump rated at 70 gallons per minute,  for the purpose of crop irrigation.  The site is located at South Street, Manorville, Town of Brookhaven.

The applicant proposes to excavate approximately 19,300 cubic yards of material (sand and gravel) to create 7 ponds for a new residential community.  This work is to occur as part of a subdivision of approximately 185.5 non-contiguous acres of land to be developed with 160 clustered condominium units, 4 acres to be retained by the current owners, and three lots totaling approximately 109 acres for agricultural preservation. Excavation for the ponds is to occur on a 44.7 acre parcel of land located south of Sound Avenue, 621 feet west of West Lane, Riverhead, Town of Riverhead, SCTM# 0600-20-2-1.  The other parcels included in the subdivision are located on the southeast and southwest corner of the intersection of Northville Turnpike and Cross River Drive/Union Ave (CR 105), between Cross River Drive, Northville Turnpike and Sound Avenue, and one lot south of the Long Island National Golf Course, SCTM#s 0600-44-2-12, 0600-44-3-2, 0600-44-3-3.1 and 0600-45-1-3.1.  

The applicant proposes to construct a single family dwelling near the NYSDEC regulated freshwater wetland designated GP-5.  Activities associated with this project would be conducted within the adjacent area of the wetland, including clearing and landscaping within 25 feet of freshwater wetland boundary.  The residence itself, a swimming pool and the septic system would be situated outside the adjacent area.

The applicant proposes to construct a single family dwelling with an on-site waste water treatment facility within the tidal wetland adjacent area associated with Flanders Bay. Variances of 37 feet from the required setback of 75 feet for the residence and 55 feet from the required 100 foot setback for the septic system are requested.  It is proposed to develop approximately 16% of the property with the remainder to consist of wetlands and a non-disturbance buffer.
