The application is to modify
the currently approved Mining Plan and Permit to add a
portable crusher that has a maximum processing capacity less than 150 tons per hour and
to change the mine operating hours, currently 8:00a.m. to 4:00 p.m. Monday through
Friday to 7:00 a.m. to 5:30 p.m. Monday through Saturday. No other changes, including
acreage (3.4 acres), are proposed. The mine is located at the northwest corner of the
Town of Little Valley, south of New Albion Road (Cattaraugus County Route 5) and
adjacent to the Little Valley - Mansfield Town Line.

County Line Stone Co., Inc.
proposes to modify its mined land use plan for the Akron
Quarry to reflect changes in the realignment of several brine pipelines and one petroleum
pipeline (Sun Pipeline) which occur on future mining reserve lands, located south of the
New York State Thruway and east of Crittenden Road in the Town of Newstead, Erie
County. The applicant proposes to modify its mining plan with a revised pipeline
location, movement of the northern excavation limit along the Thruway to the south,
modification of the berm placement and size and excavation of the narrow strip of
retained land separating the two quarry areas. The excavated mining site will be
reclaimed to a lake in the future. It is anticipated that Sun Pipeline will move the
company's line to the same area on the applicant's property, along the New York State
Thruway, where the Buckeye and Texas Brine pipelines were previously relocated. The
Revised Mining Plan and Revised Reclamation Plan are available for review at the
Region 9 NYSDEC Office.

The applicant proposes to
mine clay and topsoil, affecting 40 acres of land. The
estimated life of the mine is 5 years and the reclamation objective is a 26 acre recreational
lake surrounded by wildlife habitat and two potential residential building sites. The
project will impact 0.36 acre of federally jurisdictional wetland and compensatory
mitigation will be provided by creating approximately 1.50 acres of emergent wetland
within the mine lake. The haul road will provide access to Ridge Road.
