ENB Region 4 Completed Applications 04/07/2004

The Department has made a determination under Article 17 of the Environmental Conservation Law to approve this application for a modification to an existing permit to discharge 30,218gpd to Mosher Brook from the Ravena Coeymans Selkirk Central Schools. The modification involves adding one outfall (2,138 gpd pool filter outfall) to the existing outfalls (24,000gpd of domestic sanitary waste and 4,080gpd of floor and trench drain waste) for a total of 3 outfalls at 30,218gpd. The tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. A Draft Permit is available for inspection and comment at the Regional Office. The project is located on Route 9W in the Town of Coeymans, Albany County. SPDES # NY 010 2962.

The applicant proposes to increase the permitted annual Municipal Solid Waste (MSW) transfer rate from 35,900 tons per year to 51,480 tons per year. The Capital Compost Facility is located at 22 Simmons Lane, just north of the Waste Treatment Facility, in the Village of Menands, Albany County.

The applicant proposes to construct a 30' x 34' single family residence on Lot #273 located on Island Drive, on Robinson Pond, Copake, NY.  The 3-4 bedroom house will be constructed in the adjacent area of Freshwater Wetland CO-3 (Robinson Pond) and will be located approximately 65' from the shoreline of Robinson Pond.  The project also involves the construction of a 10' wide deck on the lake side of the house approximately 55' from shoreline and a new septic system on the north side of the lot which is located outside of the adjacent area of the wetland.

The applicant proposes to operate a 4.5 acre life of mine surface unconsolidated gravel mine.  The gravel will be used for agricultural road improvements by the landowner and for retail use.  On-site processing will consist of a screener for separation of product.  A new haul road will be constructed from the pit to County Route 18. Final reclamation will return the site to pasture for dairy cattle.   The site is located east of State Route 10, approximately 1/2 mile north of Peters Road and State Route 10 intersection.  

The Department has made a tenative determination to approve this application for a new SPDES permit (SPDES #NY-0261335) to allow the subsurface discharge of up to 10,040 gallons per day of sanitary waste.  Wastewater treatment will consist of a septic tank with on-site infiltration  The proposed system will serve a 74 unit business hotel.  The project is located on the east side of  State Route 28, south of the hamlet of Hyde Park and north of the hamlet of Hartwick Seminary.

The applicant proposes to remove an existing single dock and replace it with a two-sided dock  for docking of a tour boat and to perform maintenance dredging of approximately 173 cubic yards of material from the same dock area in Otsego Lake/FWW CP-30.  The project is located at 10 Fair Street, in the Village of Cooperstown.

The applicant proposes to operate a 5.8 acre life-of-mine surface unconsolidated sand and gravel mine of which the entire 5.8 acres will be authorized to be disturbed during the initial permit term. Mining will be conducted in three phases.  Reclamation will commence after phase 1 operations are complete.   The operation will include on-site screening of material using a portable screener.  The project is located off State Route 7 , east of Lovers Lane approximately one mile west of the hamlet of Wells Bridge.

The applicant proposes to renew an existing mining permit for the Pittstown Sand Bank, operated by the Town of Pittstown, and to reconfigure the life of mine area, resulting in an addition of 5.2 acres, for a total life of mine of 18.2 acres.  The site is located on Sand Bank Road in the Town of Pittstown, Rensselaer County.  MLF #407-2-30-0227.
