The New York State Department of Environmental Conservation (Department) administers the Brownfield Cleanup Program pursuant to ECL 27-1400 et seq. The Brownfield Cleanup Program is designed to encourage the remediation of contaminated properties known as brownfields for reuse and redevelopment. Vails Gate Manufacturing LLC has submitted an application, dated March 11, 2004, to participate in the Brownfield Cleanup Program. The application was determined to be complete by the Department on March 19, 2004. The property described in the application is located at 1073 Route 94, Vails Gate, New York 12553. The application proposes that the applicant will conduct investigation and/or remedial activities at the site. The application proposes that the site will be used for commercial purposes.
The Department will receive public comments concerning the application for thirty days from March 31, 2004 through April 30, 2004. A copy of the application as well as a copy of the Phase I Environmental Site Assessment Report and Phase II Surface Investigation Report are available by contacting the Department’s representative at the address listed below or in the document repositories for this site located at the following: Vails Gate Manufacturing LLC, 1073 Route 94, Vails Gate, NY; NYSDEC Region 3, 21 South Putt Corners Road, New Paltz, NY; and Cough, Harbour & Associates LLP, III Winners Circle, Albany, NY.
The referenced documents are draft and have not been reviewed by the Department staff prior to their release for public comment. The Department, in conjunction with the New York State Department of Health, will review these documents during the public comment period.

upon application and investigation has satisfied the requirements of 6 NYCRR Part 232, §232.3 Variances.
§232.3 Variances, allow Perchlorethylene Dry Cleaning Facility owners who meet the specific requirements of this section to petition the Department to be relieved of certain Part 232 requirements. In this instance Mr. Yong Il Son, doing business as Phil’s Cleaners sought a §232.3 Variance in relief of the §232.6 requirement to install only new fourth generation equipment at a new facility. In particular, Mr. Yong Il Son, seeks to move a used Sovrana Victory 5000, Model A50 fourth generation dry cleaning machine from the current Phil’s Cleaners facility location to another rental unit in the same strip mall at 41 East Prospect Avenue.
The Department grants Mr. Yong Il Son, Owner of Phil’s Cleaners, 51 East Prospect Avenue, Westchester County, Mount Vernon, NY 10550-2225; DEC ID 3-5508-0266; 914-664-6644; a variance from the requirements of 232.6 and 232.13 for this one instance. This variance shall be maintained by operating the facility in full compliance with Part 232 and all other applicable regulations.

Sullivan County - The Planning Board of the Town of Bethel, as lead agency, has determined that the proposed White Lake Mini Mall will not have a significant adverse environmental impact. The action involves construction of a 15,000 sq.ft. mini-mall consisting of commercial retail and office space for rent, including driveways onto CR 13 (NYS Rt 55); an exit drive onto NYS Rt 17B; connection to existing municipal sewer; an on-site water supply well; and parking areas. The project is located at the intersection of SR 17B & SR 55, White Lake, NY.

Westchester County - The Planning Board of the Village of Tarrytown, as lead agency, has determined that the proposed Legends at Wilson Park may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. A public scoping session will be held on April 27, 2004, at 8:00 pm at the Tarrytown Village Hall, 21 Wildey Street, Tarrytown, NY. The action involves a twenty lot single family subdivision on a total of 48.1 acres, in an area zoned in part for minimum 60,000 square foot lots (26.3-acre) and in part for 80,000 square foot lots (21.7-acres). The project is located on Wilson Park Drive, Warner Lane, County House Road, Tarrytown, Westchester County.

Westchester County - The Planning Board of the Town of Cortlandt, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Abee Rose Estates Subdivision. A continuation of the public hearing will be held on Tuesday, April 13, 2004 at 8:00 p.m. in the Vincent F. Nyberg Meeting Room at the Cortlandt Town Hall. Written comments must be submitted no later than April 23, 2004 to the Planning Board. The action involves a 30 lot residential subdivision, a private sewage treatment plant and proposed roads, utilities and other proposed related site improvements on 128 acres. The project is located on the south side of Maple Avenue and on the east side of Dickerson Road.
