Jamestown Macadam Inc has
requested a modification to their Air State Facility Permit.
This facility consists of three separate asphalt plants on the same property on Walden
Avenue in the City of Jamestown, Chautauqua County. The modification of the existing
permit allows the facility to burn Waste Fuel A (waste oil) and No. 2 fuel oil in Plant 3
dryer in addition to natural gas. The facility has demonstrated that the Plant 3 dryer has a
combustion efficiency of greater than 99% which is required by 6NYCRR Part 225.2.
This modified permit also contains requirements for the facility burning Waste Fuel A
and No. 2 oil in Plants 1 and 2 at some future date. This permit would also retain the 12
month asphalt production limit for Emission Units P-00001 and P-00002 at 123,250 tons
per year. It reduces the 12 month production limit for Emission Unit P-00003 from
380,000 to 375,000 tons per year. This reduction in asphalt production will keep each
emission unit under 25 tpy for each criteria pollutant. The capping conditions also keep
annual facility emissions below the Title V applicability threshold. All other facility data
remain as currently permitted. The Application and Draft Permit are available for review
at the Region 9 Office of the New York State Department of Environmental
Conservation.

The applicant proposes a
modification to their permit to reflect a cessation of a
manufacturing operations and B.R.I.C. water intake at the facility. The modification
request involves the sampling monitoring frequency for cholorbenzene, cyanide, copper
and lead be changed from monthly to quarterly and that chormium, zinc, methylene
chloride, nitrobenzene, bis(2-ethylhexyl)phthalate and pt color be changed from semi-annual to annual.
The applicant also requests that the sampling frequency of total
suspended solids, TOC, temperature, Ph and phenol be changed to monthly. Ammonia
will remain on a monthly sampling frequency. The outfalls will remain to the Buffalo
River. The Department has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under that statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
Department approval for or endorsement of the activity for which a permit is sought or
for the overall proposed project. Refer to this application by application number listed
