The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for a renewal and modification of their Air State Facility permit
to limit the facility's emission of NOX to 90 tons during any 12 month period. Therefore
the facility would not be subject to Title 5 permitting. The facility collects local
production natural gas through a pipeline system in the counties of Chautuaqua, NY;
Warren, PA and Crawford, PA. The facility includes a suction filter separator for cleaning
of the gas, 5 skid mounted compressor packages for compressing the natural gas, a
discharge filter separator for further cleaning of the gas, a triethylene glycol system for
drying the gas and a meter run for measuring the gas. The Oxides of Nitrogen emissions
for all 5 units was previously capped at 100 tons per year. The compressor station is
located approximately 2.2 miles west of the hamlet of Mayville, Town of Chautauqua in
Chautauqua County.

The Department has drafted
a modified permit and intends to modify SPDES Permit No.
NY-0000655 issued to General Mills Operations, Inc. which is located at 54 South
Michigan Street. General Mills operates a Flour Mill Plant where grain is processed into
product and a Cereal Processing Plant where breakfast cereals are manufactured and
packaged. Three sump discharges, listed as Outfalls 010, 011, and 012, which discharge
groundwater to the Buffalo Ship Canal, were added to the permit with monitoring
required for the parameters Flow, pH, and Oil and Grease. In additon, Total Residual
Chlorine monitoring has been added to existing Outfall 001 which discharges non-contact cooling water
and stormwater to the Buffalo River.

No. NY-0000337 to eliminate a Residual Chlorine limit at Outfall 001 and add a Cyanide
limit at Outfall 001C. Additionally, a new page 2a is to be inserted into the permit with
an action level requirement for Thiocyanate at Outfall 001C. FMC Corporation's facility
is located at Sawyer and River Roads where it manufactures inorganic chemicals.
Approximately 14 million gallons per day of treated process and non-process
wastewaters are discharged from the facility into the Niagara River.

The Department (DEC) has
prepared a Draft Permit and has made a tentative
determination to approve this application for renewal of an existing Title IV (Phase II
Acid Rain) Permit as required by CFR Part 72 for Huntley Power LLC's C R Huntley
Steam Generating Station located at 3500 River Road. Renewal of the Title IV Permit
will allow the DEC to continue to enforce the requirements of the Acid Rain Program.
No emissions increase will result from renewal of the permit. Prior permits issued to this
facility remain in force and include requirements for compliance with 6 NYCRR
Subparts 225-1 (Fuel Consumption and Use - Sulfur Limitations), 227-1 (Stationary
Combustion Installations) and 227-2 (Reasonably Available Control Technology [RACT]
for oxides of nitrogen [NOx]). The applicant will be required to have sufficient sulfur
dioxide (SO2) allowances in its possession to cover SO2 emissions from this facility. The
applicant shall submit annual compliance certification reports to DEC and the US
Environmental Protection Agency (EPA). The applicant shall monitor, maintain and
certify monitoring systems for opacity, SO2 emissions, NOx emissions, carbon dioxide
emissions and volumetric flow rates in accordance with the requirements of 40 CFR Part
75. In accordance with 6 NYCRR Parts 621 and 201, the Administrator of the EPA has
authority to bar issuance of this permit if it is determined not to be in compliance with the
applicable requirements of the Clean Air Act or 6 NYCRR Part 201.
