Project Location/Description: GE Silicones, LLC ("GE") is located at 260 Hudson River Rd., Waterford, NY 12188 and operates two hazardous waste incinerators a/k/a a rotary kiln and a fixed box incinerator which incinerate liquid and containerized solid hazardous wastes. GE is required to conduct a comprehensive performance test (CPT) on these incinerators to demonstrate compliance with new air emission standards in the Maximum Achievable Control Technology (MACT) rule for hazardous waste combustors, promulgated by the United States Environmental Protection Agency and adopted by the New York State (Air Program). GE is further required under 6NYCRR Part 373 hazardous waste regulations to conduct a trial burn. Thus, GE has submitted a trial burn/CPT /risk burn ( TB/CPT/RB) Plan narrating detailed testing procedures to be followed during the test. GE has also submitted a continuous monitoring systems (CMS) performance evaluation test (PET) plan as required by the MACT Rule.

Based on a review of these plans, NYSDEC has determined that both the TB/CPT/RB and CMS PET plans are acceptable and therefore, has approved them with conditions on March 5, 2004. This notice is pursuant to 6 NYCRR Part 373-1.9(a)(4) and 63.1207(e)(2) of the MACT Rule which require GE to publish this approval along with the tentative test schedule and make these approved plans available for public review.

Project Description: The application involves a three-lot subdivision of 76.7 acres and the after-the- fact approval of a mobile home park consisting of eight mobile homes and the after-the- fact approval of a multi-family dwelling consisting of six two-bedroom apartments. Lot 1 will be 1.65 acres in size and will contain the mobile home park. Lot 2 will be 8.2 acres in size and will contain the multi-family dwelling. Lot 3 will be 66.85 acres in size which includes 3.2 acres of land underwater. Lot 3 contains a pre-1973, 74-site campground known as Twin Pond Campground. Project Description: The project is a commercial sand and gravel extraction (i.e. sand and gravel pit) with a with a 2.5 acre life of mine area on a 158 acre parcel of property. The applicant proposes extraction of a maximum of 6000 cubic yards of sand on an annual basis for a period of five years. The proposed mining operation will operate from May 1 to October 31, Monday through Friday, 6:00 a.m. to 4:30 p.m. The sand and gravel material mined from the extraction will be used for repair and upkeep of Town projects in the Town of Webb. The equipment to be used in the mining operation includes a front-end loader, bulldozer, dump trucks and portable crusher. The Department of Environmental Conservation, Region 6, has a pending permit application (6-2154-00820/00001) for the project.

Project Description: Three-lot subdivision of 18.8 acres to create 6.5, 6.4 and 6.2 acre lots with one existing mobile home on each lot. The subdivision involves wetlands, but no wetlands will be impacted by the new land use and development. All existing and new land use and development is located no less than 300 feet from the wetlands. On Lot #3, the pre-existing mobile home will be replaced in-kind and in the same location with a new mobile home. Lot 2 has an accessory-use mobile home immediately adjacent to the mobile home occupied as a residence.

Notice Of Acceptance Of Draft Supplemental EIS And Public Hearing

Fulton County - The Adirondack Park Agency, as lead agency, has accepted a Draft Supplemental Environmental Impact Statement on the proposed Map Amendment 2003-13 (Smith). A public hearing on the Draft Supplemental EIS will be held on April 1, 2004 at 10:00 a.m. at the Town of Northampton Town Hall, Northville, NY. Written comments will be accepted until April 1, 2004. The action involves amendment of the Official Adirondack Park Land Use and Development Plan Map in the Town of Northampton, Fulton County (Map Amendment 2003-13) to reclassify from Rural Use to Moderate Intensity Use an approximately 230 acre parcel located westerly of NYS Route 30, pursuant to the Adirondack Park Agency Act, Section 805 (2)(c)(1). The project is located in the Town of Northampton, Fulton County.
